The actual petition will be in Bahasa Malaysia, complete with the requisites to meet the requirements of protocol for a communication from the rakyat to ruler.
The final text will be posted once the translation and protocol requirements have been completed.

The People’s Appeal To His Majesty The Yang DiPertuan Agung
On 19/9/2007, the nation was rocked by another scandal, this time in the form of a video clip which exposed what appears to be a telephone conversation between senior lawyer VK Lingam and another person, allegedly fixing the appointment of ‘friendly’ senior judges.
A careful study of the monologue presented in the video clip leaves a very clear impression that the telephone conversation is indeed between VK Lingam and the present CJ, Tun Ahmad Fairuz Sheikh Abdul Halim and relates to the appointment and promotion of judges. Other judges are also named in the course of the conversation.
That Tun Ahmad Fairuz had, subsequent to the release of the video clip, first responded that he would need to first view the video clip before saying anything, then issuing a ‘no comment’ response and only lately and that too through a third party making a bare denial of being a party to the conversation leaves us, the rakyat with a sense that Tun Ahmad Fairuz has not responded with complete candour on this matter.
This scandal now casts serious doubts on the suitability of Tun Ahmad Fairuz to head the judiciary as well as on the propriety of the appointments and promotions, made on the recommendation of Tun Ahmad Fairuz, of several judges of the High Courts, the Court of Appeal and the Federal Court.
We, the rakyat, no longer have any confidence whatsoever in the judiciary.
We, the rakyat have noted for some time that some very senior judges have been constantly overlooked in the numerous promotion exercises that have proceeded during the tenure of Tun Ahmad Fairuz, with junior judges being preferred.
We the rakyat have also noted that it was recently reported that Their Royal Highnesses acting through the Conference of Rulers rejected two nominations by Tun Fairuz for the position of President of the Court of Appeal and the Chief Judge of Malaya although these positions had been vacant for a long time. It is rumoured that those nominated by Tun Fairuz were junior in comparison with many other more senior serving judges.
We, the rakyat, have further noted that there is at least one judge promoted to the Federal Court who, it is reported, has failed to deliver written judgments in up to as many as 35 cases, with the result that appeals by many who have been convicted of offences and are in prison are unable to have their appeals heard.
This most recent scandal also raises again real concerns about the sudden change of the trial judge in an ongoing murder trial in Shah Alam.
We, the rakyat, are also gravely concerned about the recent decisions in several high-profile cases and whether these were ‘fixed’ by Tun Ahmad Fairuz and, if so, the implications it has in relation to the other judges of our superior courts.
The reaction of the Prime Minister, other members of his cabinet and the Attorney-General to the matter of this video clip give us, the rakyat, no reason at all to believe that this scandal will be honestly investigated so that the truth of the matter will never be known.
We, the rakyat, do not believe that the Prime Minister and his present government are committed to getting to the bottom of this scandal and, if ascertained to be the truth, to take all necessary steps to restore the judiciary as a constitutional institution emplaced to independently defend the constitution, the rights of the rakyat, and to uphold the rule of law.
In this regard, the announcement on 25/9/2007 by the Deputy Prime Minister of a 3-man panel to be headed by one who was implicated in the sacking of Tun Salleh Abas in 1988 to now investigate this scandal fortifies our belief that the present government is determined that the truth in relation to this scandal never becomes known.
We, the rakyat, are gravely concerned that if this scandal is left to be investigated by the administration of the Prime Minister, the police or the Anti-Corruption Agency, the rakyat will only witness another cover-up, leaving us, the rakyat without any recourse to justice, ever suspicious whether the judiciary is to protect the rakyat or the interests of a chosen few.
This most recent scandal raises concerns whether the corruption that has become so prevalent in the management of this country has now also made its way into the judiciary.
For these many reasons, we, the rakyat, now pray that Your Majesty may be so moved and in the exercise of the full powers conferred on Your Majesty to :-
- direct the establishment of a Royal Commission to inquire into, consider and/or determine whether in fact the conversation reflected in the said video clip did occur between VK Lingam and Tun Ahmad Fairuz and the veracity of the assertions made by VK Lingam in the said video clip and, if found to be so, that the Commission be further mandated to enquire into, consider and/or determine:-
1.1 the involvement of all those named in the said video clip in connection with the appointment and promotion of judges;
1.2 cases in which VK Lingam was involved and which were heard and / or decided by Tun Ahmad Fairuz and / or any of the other judges named in the said video clip;
1.3 all acts carried out by Tun Ahmad Fairuz during his tenure as Chief Judge of Malaya, President of the Court of Appeal and Chief Justice, more particularly:-
- the basis of the appointment and / or promotion of judges by Tun Ahmad Fairuz with particular emphasis on the other judges named in the said video clip;
- the manner in which the members of the panels of the Court of Appeal and the Federal Court were selected by Tun Ahmad Fairuz during his tenure as President of the Court of Appeal and Chief Justice; and
- the manner in which files were allocated to the panels of the Court of Appeal and the Federal Court by Tun Ahmad Fairuz during his tenure as President of the Court of Appeal and Chief Justice.
2. the Royal Commission having ascertained that the conversation reflected in the said video did occur between VK Lingam and Tun Ahmad Fairuz and assertions made by VK Lingam in the said video clip to be true, to :-
-
direct the Prime Minister to take all necessary steps to appoint a tribunal under Article 125 of the Federal Constitution to remove Tun Ahmad Fairuz and/or any and all judges found by the Commission to have been implicated, directly or otherwise by the acts of misconduct of Tun Ahmad Fairuz; and
-
direct the Prime Minister to take all necessary steps to suspend Tun Ahmad Fairuz and/or any and all judges found by the Commission to have been implicated, directly or otherwise by the acts of misconduct of Tun Ahmad Fairuz, pending the reference to and/or report of the tribunal.
3. direct the immediate establishment of an independent Commission for the appointment and promotion of judges to the High Courts, the Court of Appeal and the Federal Court.

In some respects I wish Malaysian society was more like the Japanese: no tainted Japanese leader – PM or otherwise – has ever survived for long politically after their misdeeds were brought into the light. Japanese society does not tolerate them.
It was clear from the outset that no accountability was to be forthcoming from the government. It’s time we the people held the government accountable, whether they like it or not.

If VK Lingam is a man of Honour and if the Chief Justice is so sure it was not to him that the man who looks liek Lingam is speaking, then both of them should have been the first persons to demand an Independant Royal Commission to inquire into this case and establish the truth. Much had been created to bring the disorder of present government as well as the judiciary to Agong through petition by your goodself and RPK of which I had also sign to support.
What puzzles me (apparently I am new to all these blogs and scenario) is all these events are not something new, and is it that our rulers are the while not being highlighted either through petitions or any other means of communications by so many scandals and disorder, why than till today we are still soughting the call for our rulers to straighten things out. My apology to our rulers, if there are such petitions before, are we saying our rulers are just as stamp holder only or are they also sleeping like AAB, again my sincere apology to all our rulers. All these scandals are nothing new but through years but nothing change or are we moving to look the same as Mynammar, hopefully not

It appears you have overlooked that when Dr. M moved to remove the power of veto accorded to our constitutional monarch in 1993 ( I think it was that year ), the rakyat responded as it has for a long time on such matters.

The Government during the Mahathir era and the current one has systematically destroyed the Judiciary Freedom of this country. The integrity of the Government is questionable and a mere 3 men panel do not suffice to unearth the truth. A Royal Commission is of utmost importance. I support the move.

I say anything such as a panel-short of a Royal Commission-is just a devious age old device of buying time to allow criminals ample time to establish alibis, coerce or bribe witnesses,etc. in a crime.

Yes, the Royal Commission is critically needed to be set up as the majority of the Rakyat are counting the credibility on the Royal House than the defected Government! The three men investigation panel was merely set up hastily to subjugate the immense feelings of injustice of the people and it means no difference to the people since we have no fate in it, they are powerless and being looked at as the espionage group to gather feedback from the people in favor of the ruling party! We need the Royal Commission now!

Don’t be political stooges to the spent and bankcrupt politician like Anwar Ibrahim. He accused others of staging conspiracy against him but actually he is the Mother of all conspiracies.Remember the doctored photo purportedly of TPM,Razak Baginda and Altantuya by Tian Chua, PKR Information Chief…..I strongly believed that the VK Lingam tape is doctored and fabricated.

Maybe you should also mentioned how Nazri proclaimed that Fairuz didn’t need to answer any questions because “I am his minister”.
This clearly shows a lack of independence between the executive and judiciary bodies.

I am beginning to lose hope in the govt and the idiots who walk the halls in the Parliament. Corruption cases are being swept under the carpet and billions of taxpayers’ money are being squandered. Judiciary – return to the people – is long overdue. It has lost its lustre and my confidence. Some of the judges in my view are not fit to be there. They are afraid to pass judgement for fear of losing their position.
Facts of some of the appeal cases are so clear and yet they take months to arrive at the verdict. Sometime, I just wonder whether they are really competent.
I held once that judges were the guardians of social conscience and justice. But, definitely, not here in Malaysia.
I will certainly support the petition to SPB YDP Agong. I hope that through his position, he can exert his power to right the wrong.

Its an irony that the guidelines given to the three man panel is to investigate the authenticity of the video clip and not what is happining in the clip. Another attempt to cover up I must say. Many of us asked y nobody took action when the Executive took away the power of our rulers then. Well if i remember correctly there was alot of abuses by members of royal family those days n now i think the check n balance is in place n there have definitely been better behave. All that been said it is sad to see that the transfer of power fr one to the other has been abuse by the latter now n it has actually spiral out of control.
The independent of our judiciary is of utmost importance in our democratic society so citizen can live with no fear n that we all can seek redress in our court irrespective of race,gender or religion. I therefore support your petition to our Agung so that the truth can be known n action taken to correct the situation. The power of the elected few must be control n check at all time to make sure that they r there to work for the rakyat n not ot line their pockets.

All the misused powers & corruptions should have been burnt down ages ago. Aren’t we suppose to live in democracy? Unfortunately ‘democracy’ has been abused, therefore people live in fear rather than speaking their minds out. But those who undisguised the truth publically were dumped into ISA; “dungeon of hell” they used to call it.

Corrupted politicians should be punished by the Almighty.The Universal Law Of Cause & Effect will soon takes its Natural Cause. I totally support this cause. I love my country and my friends of all races but it really hurts and my heart bleeds to see the potential of where we can be as a nation going down the drain day by day. Unjustified biasness,lack of enforcement and inconsiderate action in almost every sector is ruining the countries reputation. It’s time all of us face up to the truth stand up and speak up without fear or favour to make Malaysia a better nation.

I support the petition, although odd to resort to monarchy to help re-establish the independence of judiciary – a democratic institution.
Also, while the wording is generally right, it seems to single out Tun Ahmad Fairuz too much. Obviously he is the main person implicated in this particular tape. But this petition is not meant to be a singular ‘witch hunt’ so much as a particular appeal to general principles of justice, yes?

I do not think the worry is Lingam, by all accounts if it is actually Lingam, then we must realise that Lingam is a non issue, here what is, is the restoration of the dignity of Justice George Seah and Pawanteh, and to right the wrongs done to this two honourable gentlemen and also that of Tun Salleh Abbas.
The nation knows that Tun Salleh Abbas was a man of integrity and those Judges and politicians who disposed of him and his two fellow judges were nothing but a bunch of of hoodlums.
If as alleged the person shown on the Video clip is indeed the person we all suppose he is he must be tried as a common criminal, because if what we have seen is the truth than that is what he is.

In Malaysia, there is no minority …. only minor- majorities. But sad to say that the minor-majorities including the Rakyat can say so little, not to mention do so little, for so many to so few! It’s time that the Rakyat and the minor-majority wake up and take some actions for the betterment of the younger generation and generations to come. This half-past 6 Government and the cronies have already done too much damage, taken too much control, spoken too much rubbish to the populous. Now is the time for the people to rise up, for the people by the people, towards the future.
Malaysia is too beautiful a country, with its multi-racial, multi-religious and multi-lingual cultural mix to be left to selfish, self-interested, conceited and arrogant, so-called cronies to run it. The people should now rise to the occasion.

I support the petition. The legacy of blatant interferences by the executive on the judiciary is scandelous and downright evil. When all is said and done (finger-crossed) there will be a plaque erected somewhere saying “This is what Mahathir has done to the country and Judiciary – raped and molested and he got away with it”.

I am very sorry i received this blog so late. I have been seething with anger with the injustice and corruption for so long therefore by signing the petition I am glad I am able to voice out my disagreement with the way the judiciary has been since the 1988 crisis.
I am young, only 21 but I hope my voice counts as a vote to right the system again and fight for a proper separation of powers.

i wonder if this petition is going to be another act in futility like all the other times like the voices against the toll charge raises which was met with a response smack of arrogance from the government formed by MPs we ourselves elected. Honestly, samy? nasri? they are all in the same boat stuck perpetualy in very dense fog!
but i still sign my support and pray that this will move the powers that be and maybe convince some of our fellow complacent malaysia brothers and sisters to stand up and be counted if not for themselves then for their future generation.

Jahanam negara ni!! Kalau semua rakyat nak tentukan!! Tengok aja Thailand apa jadi??? Siapa rugi??? Rakyat juga!!! Tengok Philiphine !!! surat rakyat??? Apa jadi akhirnya ??? Ada orang hanya pandai merosakkan tapi tak pandai nak membangunkan!!! Bila orang bangun sesuatu pandai dok komen itu tak betul ini tak betul. Tapi sendiri tidak ada kemampuan pun!!!! Tak ada kote!!!
Bersyukurlah!!! Mana ada keadilan secara total dalam dunia ni!!! Selagi manusia yang menjalankankan hukum!!! Hanya ALLAH yang MAHA ADIL…. Mana ada jaminan tidak korupsi 100%….itu semua omongan orang gila kuasa nak memerintah negara!!!! Kalau dah kalah dalam PRU12 dan tak dapat bentuk kerajaan tunggu ajalah PRU13 nanti. Jang dok riuh rendah dalam kandang macam ayam sabung. Bila masuk gelanggang kalah juga. Tapi kalau takdir ALLAH nak beri BALA kat bangsa MALAYSIA, negara jatuh kepada pembangkang, kita tengok pulak gelagat orang gila kuasa macam LIM KIT SIANG & Co, KARPAL SINGH & Co, ANWAR IBRAHAM & Geng.
PAS kena ingat dalam PRU12 kalau dianalisa kemenangan PKR DAP banyak bergantung pada undi MELAYU ISLAM!!! Tengok aja gelagat DAP di Penang dan PERAK meluat aku dibuatnya!!!! Tidak perkauman konon!!! Jangan cuba tipu!!! Itu baru negeri kalau negara huru hara jadinya!!!
