Petition on the Zaki appointment

‘I thought I read in the Sun yesterday, that Zaki was already sworn in together with the new CJ. Is it true? If it’s true then, there is no point in petitioning anymore’.
splim, apart from the Sun, this news item was also carried in the Star.
Strangely, neither NST nor Malaysiakini had any report on this.
I called some of my contacts in the media to make inquiries. Most said this was news to them and that they would check and get back.
One did.
This particular journalist informed me that this journalist had checked with sources in the AG’s chambers and was informed that Zaki has not as yet received his ‘watikah’ ( which, upon further inquiry, I was informed is the letter of appointment bearing the Agong’s assent ).
15 minutes ago, I received information from a source that I consider to be reliable that Zaki received his watikah yesterday.
It would therefore appear that Zaki has indeed been appointed as President of the Court of Appeal.
Back to splim’s take : if it’s true, then there’s no point petitioning anymore.
The petition is not mine. It’s ours.
I am in favour of still sending the petition in to register with His Majesty that some of us were not in favour of Zaki’s appointment prior to a finding by the Royal Commission.
People, please guide me on this.

Sir,
I’m not trained in law, hence, a few questions:
1) Assuming Zaki has received his watikah (2 different version from the media, I’m still hopefully reluctant to believe he has), are there any chances that this appointment would be nullified due to the voice of people that disagree with his appointment? Are there provision in the law to do so?
2) According to the constitution, can a monarch readily withdraw his consent, assuming he states there is genuine concern from the people regarding the appointment of the above mentioned judge?
3) Are there other channel or provision by the law and constitution by which this can be challenged?
In my humble opinion, with all due respect to ’splim’, I would support you to still go ahead with the petition even if Zaki has received his watikah and the answer to my questions are not in our favour. At least there would be a record to say that from the beginning, the people did question and raise concern regarding this appointment.

I found out that Zaki’s photo and profile put up to the kehakiman’s website yesterday, but before that his pic and profile wasn’t there. That’s probably true.
I agree that we should send out the petition anyway.

Please go ahead with the petition submission, even if it’s after the fact.
As Nanda said, at least there’s a record of civil society’s concerns on ZA’s appointment.
Let’s not forget that the RCI will begin their deliberations (soon, I hope) and the crux of the matter is still judiciary tampering which, invariably, will include the Executive (depending on testimonies of the witnesses and the subsequent proceedings). Therefore, what happened in the past is equally relevant to the present administration.
In other words, building up the body of evidence is crucial to obtaining the proper outcome.

If you believe the petition can serve some purpose, please go ahead. I’ve already signed much earlier. Perhaps you may need to alter the petition a bit since we can’t petition for deferment of Zaki’s appointment anymore as he has already been appointed.
Btw, did you make a mistake on the heading for this post? It has nothing to do with Rashid or any Bill?

Please go ahead with the petition. I am surprised that there are so few signatories. Hey, Bersih supporters, where the hell are you? I think we should go ahead with the petition to register the rakyat’s objection eventhough we are too late for the Zaki appointment. Folks, remember the next CJ appointment is not too far away! Haris, I am full of admiration for your leadership n tireless effort to get our country back on the right track.

I support the idea of the petition even if Zaki has already received his watikah. It is a neutral indicator of the people’s opposition to the Executive’s action in appointing him and thereby ignoring the senior Federal Court Judges, who have served well at the High Court and the Court of Appeal before assuming their present position. Zaki,on the other hand, was only appointed to the Federal Court a few months ago. Whatever experience he has as a practising lawyer is still not comparable to the judicial experience of the senior Federal Court Judges who have been left out.
Go ahead with the petition !

If Zaki has been appointed and gotten his watikah, there seems to be no point in petitioning anymore. Can we not instead voice our displeasure, disagreement, objection and what not, not to the DYMM YDPAgong but to PM and to the powers that be. Instead of just the NGOs and political parties etc voicing their objections, the rakyat (signatories) too are echoing the same.

We need a rally like what the Bersih did if we really want to make this petition a success. No point getting all the signatures and hand in the petition secretly. Someone will just throw it into the dustbin. To gather more people, add in the recent issues like the amendment of Article 114 to increase the retirement age of the seven members of the Malaysian Election Commission from the current 65 to 66 and the abuse of ISA on Hindraf’s leaders that will stir up racial tensions.
Tough I don’t support what the Hindraf leaders are doing but arresting them and linking them to some terrorists organization without prove is far more worst. If the Indian can march peacefully with the Malay, it will give a superb signal to the rotten government that the Indian are NOT against the Malay. It is also a good signal to promote the unity among Malaysian rather then seeing a race base rally.
Organize the rally not during weekdays or weekend but during the upcoming holiday like Christmas or New Years Eve! It is not easy to organize a huge rally especially the time is so short. Even the Bersih rally took months to prepared. However if we can make it happen during Christmas, we not only drawn attention from the government but the world itself. Countries around the world will celebrate Christmas and we will be the only country rallying that day. Cool isn’t it!
Someone once suggested that we should organize a rally for the whole country, not in KL alone. It was a good idea as people don’t have to travel so far and we can spread out some of the police force rather then letting them focus all their might in 1 spot. The protester might be lesser due to the crowd being spread out but the entire nation would be on rally on the same day like what we did during the era before independent.
Well this suggestion might be a bit radical but with our current situation, only a radical move can change it. Deny BN victory in the next general election? Well, with the UMNO doggy Rashid as the EC, what do you think? Deny BN 2/3 majority power? Lol, the moment Article 114 comes in power, it will be Rashid turn to show his power!! And with Zaki on the Court of Appeal, I wonder if our opposition MP can appeal their election foul cases. Lol, you will soon see alot opposition MPs lose to BN on foul issue, not in numbers!! OPEN YOUR EYES PEOPLE!
Err sry for the long post Haris as too many bad things happen in our country these few days. Need to release some anger. Hopefully someone will read it >.< .

Why not A PETITION TO DAMAI to ask for the 395 NGO it represents?
To allow petition from any of the 395 to ask for better sense.
Or any of the 1.5 million members to verify they agreed to the message it was sent!
