Pak Lah promised us much in the run-up to the 2004 elections.
He failed to deliver.
The rakyat punished him and the other goons in BN big-time on 8308.
And before the dust from the 12th GE could settle, Dr M and many in UMNO were baying for Pak Lah’s blood.
Responding to this, Pak Lah started to speak of reforms again.
The first reform one would have expected would have been in his cabinet.
Ok, he dropped a few who had long outlived their shelf life.
And he brought in Zaid.
But he also brought in ‘I no speaking Inglish’.
And retained Bodoh!Bodoh!Bodoh! and Daggerman.
If any had harboured hopes that the election battering would have jolted Ole Big Ears from his slumber and he would now be ready to deliver on his past promises, his cabinet selection, barring a few, ought to have put paid to those hopes.
Still, Pak Lah made more promises.
Like this one.
‘This Government gives its commitment to the Malaysian public that it will begin a process of judicial reform. We recognise that this process must be undertaken with the spirit and belief that no one, not even those entrusted to govern or to make laws, must assume to be above the law.
This Government continues to guard against abuse of its powers, and is now proposing measures to further solidify and entrench the doctrines of good governance and the rule of law.
As a result of many events, which culminated in the inquiry undertaken by the Royal Commission into the so-called “V.K. Lingam Tape”, I am aware that the public considers the present way of appointing and promoting judges as inadequate.
The absence of a system in nominating candidates has led some to believe that the process is characterised by abuse, even where there is none. As is often the case, perception can lead to reality.
On the other hand, some may argue that the present system does not require improvement if people in the system are inherently honest and fair. The same system has produced its share of outstanding judges after all.
I do not dispute this, but the fact is, we can no longer leave such an important institution to hope and chance. The system must have built-in safeguards to prevent potential abuse and it must have a process that will convincingly identify the best legal minds in the country to join the judiciary.’

Malaysianinsider reports that at the cabinet meeting this last Wednesday, Zaid’s proposal for the Judicial Appointments Commission was shot down as ‘Cabinet ministers yesterday disagreed with the composition of the body and voiced concerns over the possible dilution of the prime minister’s powers’.
Zaid’s proposal : the commission, comprising of 13 members, including lawyers and former judges, would deliberate on prospective candidates for appointment to the judiciary or promotions within the judiciary, and then send their proposals to the PM.
The Malaysianinsider report would suggest that opposition to Zaid’s proposal is principally from the UMNO ministers. Apparently, they aren’t keen with the idea of having lawyers and former judges on the commission.
These UMNO ministers are reportedly concerned that the PM’s powers to appoint and promote judges will be usurped and that the make-up of the commission may lead to the loss of Malay control over the judiciary, leading to the possibility that non-Malays may be elevated to the top positions in the judiciary.
What about the non-Malay, non-UMNO ministers?
Liow Tiong Lai, Peter Chin, Douglas Enggah Embas, Ongkili, Ng Yen Yen, Subramaniam, Tee Keat, Ka Chuan, Dompok?
Did they not argue in favour of Zaid’s proposal?
Can they not see that UMNO is not serious about reforming the judiciary, about returning to us, the rakyat, our judiciary?
And if they can see this, why will they not take the cue from SAPP?
Tell Pak Lah and UMNO to honour what was said in that speech on 17/4/2008 that this ‘Government gives its commitment to the Malaysian public that it will begin a process of judicial reform…The system must have built-in safeguards to prevent potential abuse and it must have a process that will convincingly identify the best legal minds in the country to join the judiciary.’ or they will walk away from BN.
Or has nothing changed post 8308?
All still the running dogs of UMNO?
The Malaysianinsider report also has it that the UMNO ministers and politicians are not too keen on judicial reforms as they think it is not a matter of particular concern with the average rakyat.
I can believe this as I have heard this all too often both in private and publicly.
That Bodoh!Bodoh!Bodoh minister is infamous for this.
Lil Hummingbird also tells me that Zaid’s proposal to restore to the judiciary ‘the judicial powers of the federation’ that were removed by the 1988 amendment to Article 121(1) was also shot down.
Notwithstanding all that the BN ministers have heard and seen through the Lingam RCI report, the Ian Chin revelation and the latest by Azmi Kamaruddin today as reported in Malaysiakini about Dr M’s efforts to control the judiciary, they still wish to see retained to the PM an unfettered discretion in the choice of judges.
Or they don’t care enough to make a stand.
In my view, reforming the judiciary is the single-most important change that must be brought about.
Reform the judiciary and slowly but surely the other ills in the country will start to self-correct.
The stance of the BN government on this issue must make it clear that there is no real will within the government to bring about the rakyat-desired changes in this country.
If BN is to deliver the reforms that you and I desire, BN must itself first reform.
For that to happen, UMNO must first reform.
That will never happen.
If we are ever to restore our judiciary to what it once was, we will have to first send BN to hell and make sure it never comes back.

To do this, the Rakyat was promised again and again by Anwar and his Pakatan Rakyat.
All this talks (and NO ACTION) about defection and bringing down the BN government is making the Rakyat growing feddup with Anwar.
He and his Pakatan Rakyat dream is fast losing the trust of the people.
If he is going to be just another racist UMNO, then he can just forget his PM dream job.
And with PAS’ head so much bloated that they went as far as proposing Islamic laws in the 5 states, Pakatan Rakyat is nothing but just a scam.
WHat’s this talk about multiracial, that PAS will stop pursuing its Islamic State dream when CAMPAIGNING during election?

Haris. Those UMNO Powerbrokers are spot on with this one. The average Joe or Jane on the street (much less those at kampungs) don’t bother taking up his or her grouses or grievances to the courts. Usually they make a beeline for their MPs, ADUNs, or Ketua Kampungs. As far as they are concerned, if it doesn’t hit ‘em in the pockets and stomachs, why bother? What they don’t see or feel can’t possibly benefit ‘em, ya know what I’m sayin’?
Or just mebbe it’s a case of mistakin’ the trees for the forest…

UMNO will never reform. That is something all of us OUTSIDE of Barisan Nasional can see. But those on the inside seem to close their eyes on this. Perhaps some eyes have been forced open with the GE2008 results, jolting the likes of Chua Soi Lek and Lim Keng Yaik wide awake. But this is not enough. Not enough to make much difference.
SAPP has announced after their meeting that they endorse the vote of no confidence against the PM. But they have decided to remain in BN nevertheless. Why?
And why didn’t the other component parties come forward? Lim Keng Yaik had the guts to dish out suggestions on how BN can remain relevant, and how to counter UMNO’s supremacy in BN. But so far, nothing has been done. Was it all just talk?
UMNO needs to know its place. UMNO may stand for “United Malays National Organisation”, but that doesn’t mean they can boss over the other component parties in Barisan Nasional as if they were UMNO’s coolies. And it’s about time the other component parties stood up, not so that they can fight for the rights of “their people”, like MCA for Chinese and MIC for Indians. They have to stand up so that UMNO doesn’t boss them around anymore. Or are they used to it so much so that they don’t mind?
The present govt is Barisan Nasional. But do we really believe that? It seems more like UMNO is running the entire show, and the other component parties are merely the “extras”. Judiciary reform is one very important step. Personal interest has to be put aside. And if UMNO members can’t do that, it’s very much up to the component parties to force their hand.

Dear Haris,I am sure you are aware that the majority of BN ministers are Malay Muslims.Only a handful of them are non Muslims or better known as kaffirs.With this majority group sharing the same mindset as our dear Mahaguru 58 (that they had secured a place in heaven by virtue of being believers),how can they be fearful of hell and do as much good as possible to avoid being consigned to hell? At the BN point of view, there is no reason really “reform” the judiciary system. Why ?
because most of them affraid of they might end up in the prison !! The only way is to force the BN gov down !! The politician in Malaysia these days no longer fight for Rakyat !! Don’t we see it ?
The politic of malaysia have been too “static”, 50 years under BN is a long time and shall we give another 50 years for BN ? BN have failed to unite the Malaysian. Don;t we see it ? They do not want unity in this country!! don’t we see it ? The only way to transform Malaysia is thru a “Dynamic” politic, for example 2 party system.
I can;t see BN can do any good for Malaysian for next 50 years. Simply because they are “really” sick and have been living in that sick world for long long time.

I agree with you that an independent and clean judiciary is a sine quo non for the proper functioning of a democratic state that we all yearn for. At the same time, I also agree with views expressed here that most average Malaysians do not see the urgency in this judicial reform as well as its importance to their daily survival.
So can I suggest u initiate a campaign to educate as many Malaysians as possible on the importance in seeing through this judicial reform that the BN government has promised to undertake, as well as to keep a hawk’s eye on attempts to frustrate YB Zaid’s effort towards this end. I believe if Zaid fails, this promise by the PM may be left to lapse and we would have lost another window of hope. You can constantly educate readers in your blog on how important this judicial reform (particularly, amendments to Article 121(1) pertaining to restoration of judicial powers of the courts)is to the daily lives of every Malaysian, whether we are under a BN government(as of now) or a PR government(in the future).

Haris, like with Yong TL, they (the non-Malay, non-UMNO ministers) probably have some “files” on their “good” deeds with the ACA which will suddenly surface should they dare to step out of line.

An UMNO MP works his guts out to get to where he is in order to plunder! After which, even if he is found out, he wants the assurance that he can keep what he has plundered.
The existing judicial format gives the UMNO leadership this assurance. You and Zaid want that changed.
The other BN component party leadership see themselves and their own positions within their own parties and within the government to be at the pleasure of UMNO. They recognise, acknowledge and submit to it wholeheartedly as their personal rewards are just too great for them to bother about conscience.
That being said, can you now see why they all must reject the changes Zaid is proposing?
This is why, we really have no choice but to ensure that BN is gone forever. If BN ever loses out, I forsee the break up of BN as a coalition. There is no more reward in submitting to UMNO.
All these buggers in BN today are there submitting to UMNO’s whims and fancies only because the rewards are just too great. It is quite alright to say yes sir and no sir to any UMNO leader wannabes. Out of Government and no more rewards to dish out, is it even conceivable for MCA to stick around? Or for that matter MIC? Gerakan will very quickly say that Pakatan is more closely aligned to its own objectives than BN ever was.
I think all BN members should know what the score is going to be like. There is a necessity to begin to undermine the BN coalition itself. Maybe its about time we teased the MCA,MIC, Gerakan and the other East Malaysian parties out of the coalition. Yes, indeed shame them. After all it takes one to be shameless to submit to idiots and bullies in UMNO.

I discovered something that shocked me yesterday:
Since Pak Lah took helm, Petronas has contributed RM 146.5 billion to the government. Petronas has been in operation since 1974 and contributed a total of RM 336 billion to the government. Pak Lah’s first 4 years in office received 43.6% of Petronas 35 years of total contributions. It is more than what Mahathir received in 20 years, inflation adjusted. And it does not even include this year’s contributions!

IPCMC, no petrol hike, control inflation, excellent education,higher income for the ppl,world class public transport, reducing crimes, fights corruptions, abolish APs and so forth, all these bullshits are from our so-called BN Federal Guomen political leaders.
The 51% BN voters may be still stand behind BN, but their actions have caused so much hardships to the others(BN still become the Fed Guomen).
I salute the 49% of the voters who voted for PR, they are the one who are aware and they know very well that BN can never be trusted, because they never change, and may be never want to change.
This is because the UltaManNo believes that the 49% voters are only angry with certain BN leaders, and therefore they protested during the last GE on 8 Mac.They strongly believe that these voters will come back to BN.
How naive they become. May be the majority of the 51% BN voters also start to feel the pain now, so Haris is right,what are those MPs in BN waiting for?

think you are right. latest from reformist zaid admit that he may be over-optimistic with his reform plans for the judiciary as there are many opposition within UMNO bigshots. only regret he didnt name these objectionists. now, the Judicial Commission is being delayed but the key question is until when? After the divisional election? After UMNO election, which is more of a yearly gathering with no contest really, in December? or the Judicial Commission will be a watered version and suffer the same fate as the IPCMC?
