Last Friday, retired Supreme Court judge Azmi Kamaruddin, one of 6 former judges who were payed ex-gratia sums by the government in relation to their treatment during the judicial crisis of 1988, made the following statement about why, in his view, Dr M had amended Article 121(1) of the Federal Constitution in 1988.
“I felt that he wanted to rule like a dictator. He (Mahathir) was already the head of legislature (and) he wanted the judiciary to be under his control as well. That was his intention. I’m sorry to say but Mahathir is actually very clever in killing two birds with one stone. I say that because what he did was very clever in a sense because he wanted to amend the constitution and have the judiciary under him,”

Yesterday, NST online reported that Dr M, responding to Azmi’s statement, said :
“I am very saddened by Azmi’s statement. Immediately after receiving money, he opens his mouth against me. If this is not bribery, what else can it be?”
Everyone knows Dr M.
Not many, though, may know Azmi or of him.
I, too, do not know Azmi personally, having only encountered the man in court on two occasions.
Let me share my experience on those two occasions.
One month after being called to the Bar, I was in the Supreme Court, appearing for an Appellant.
You can well imagine how nervous I was.
Azmi was one of three judges hearing the appeal.
Midway through my submissions, he interrupted me to say something like this :
“Young man, I’ve not seen you here before. I assume this is your first appearance in this court. We are not rushing you, so do not rush yourself in your submissions. We will give you all the time you need”.
And give me time they did.
5 years later, the Federal Court was sitting in Johor Baru. Azmi was one of the three judges. I appeared, with my opponent on Monday, only to be told to come back on Wednesday, as the court would be hearing other matters on that and the following day.
On Wednesday, we were told that a case that had started on Tuesday was still continuing and so we were to come back on Thursday.
Come back on Thursday we did. That case from Tuesday was still continuing.
By the time they finished and the court was ready to hear us, it was almost 4pm and we were told that the judges would not be sitting the following day.
The judge chairing the quorum, Chong Siew Fai, asked me how long the appeal would take as all three judges were due to catch the evening flight back to KL. Before I could answer, Azmi leaned across to Chong and whispered something, whereafter, Azmi turned to me and said :
“Please proceed, Encik Haris. We will hear you and Mr________ even if we have to miss our flight.”
They heard my opponent and I until almost 6.30pm and the three judges missed their flight back to KL.
That is the Justice Azmi Kamaruddin that I know.

thats his way of doing things. mahatir will bribe his way with contracts and goodies to secure absolute loyalty. if you try to be too smart, he will then use threats. and if you still dont toe the line, God bless you.
and he thinks everybody thinks and works like him and he forgot that there are people in this world that are untainted and of principle and who will not sell their souls for money.
can someone enlighten him on this and stop tarring everybody that is not in agreement with him.

Dear Brother Haris,it will not take a genius to answer your question.Only TDM’s family and his business cronies will still take in his words.For the rest of us,I am sure by now we all knew what kind of man he is.It is very tiring to talk about him.It is very sad that our country has lost the service of some very conscientious judges through sacking and retirement.With the exception of a few good ones,the rest are all UMNOputras doing BN’s bidding.May God bless Justice Azmi good health and long life.

I have no doubt in my mind that your judgment of Justice Azmi is correct and true. Mahathir is known to be a liar, just like AAB is (in)famous for. I have faith in the many good, decent and God-fearing people here in Malaysia, including Justice Azmi.

Whom to believe? Obvious and glaring answer. 90% of the rakyat would lean on the retired Judge. The other remaining 10% are all but the cronies of we-all-know-whom. Ask a stupid question and you’d get this answer all round. If he feels so strongly against this dictatorship remark, he can always sue.

Azmi has been critical of the Mahathir regime for many years (not only after getting some money as alleged). I remember a speech he gave at a conference organised by a local university law faculty in 1989 (where incidentally I was then teaching). He was critical in the most classiest of ways. I remember telling him, when we had a moment in a lift ride, together with others, that obviously he believes that lightning does strike twice in the same place. To which he gave a sheepish but generous smile.

Let Mahathir mahablabber lo! – we all know whom to believe. After some time Mahablabber isn’t even entertaining anymore – except to his wide eyed and wide mouthed hero worshippers!
On a more serious note – thanks for highlighting the lack of a very essential aspect in our constitution after the amendment during TDM’s reign (thanks for the umbilical view & explanation of that infamous dictator-producing amendment ). Being legal-ignorant, I never realized the seriousness of the consequences of that amendment! It gives sweeping powers to the executive!

Going by how Islam judges things, I will believe in what the judge said. This is because the Prophet (pbuh) said: “We judge by what see and Allah is responsible for the concealed.” Knowing who Mahathir is and having observed him, then one is compelled to brush aside his objections because he has destroyed many things for it to be a simple case of a judge having an exe to grind with him.

Sure Haris, as you said, “not many know Azmai…”. But people like him and salleh abas who talked cocky after getting a hefty “present” from the the government of AAB, SIL&CO. do not have an iota of respect from me! To me these people are the ultimate hypocrites and real world examples of the the money talks mentality of our ex-judges who are supposed to represent the judiciary… what can we expect from our judiciary with people like this running it?

Mahathir was and still is a liar, remember he said without blinking his eyes that his sons were directors of 100+ companies each due to their own capabilities and not because they were the PM’s sons ,hahaha…
Prior to 1999 GE, Mahathir pretended to agree to appeals by “Suqiu” as he knew that he needed Chinese support to win the election, but after BN was returned to power , he immediately accused them as communists, extremists…
If you ask me , I would say most of the shits we are facing now were created by Mahathir !

Who can trust a politician, especially a barefaced and shamless one like the mamak Mahathir? AAB is just too unlucky to have inherited the shits left over by the mamak. Because the shits is too deep and the stench too unbearable, the country needs one who is much more capable than AAB to clean up the shits.

I don’t know why you appear surprised at Mahathir’s spin. Mahathir never understood the meaning of “Rule of Law”. He does not have the intellectual ability or cultural training to understand and accept the sanctity of that concept.
He wanted to and believed that it meant “Rule BY Law” i.e. HIS laws. Mahathir is not an intellectual.Yes, he is a medico but not much more than that. Some medicos are intelelctuals but Mahathir is simply is a qualified technician. Like most of your readers, I will accept anything Mr Justice Azmi says over the spin of Mahathir and his lackeys. Sad, for his a former PM but true.

Surely he is not a monster as everyone think he is? Surely there were some Hallmark moments that touched the heart involving dr M?
