Malaysiakini reports that Bala is holding a PC this morning at the Prince Hotel.
Bala this morning has issued a new SD and has retracted the SD released yesterday in which he had implicated Najib to murdered Mongolian Altantuya Shaariibuu.
Appearing at the PC with another lawyer other than the one who appeared with him yesterday, Bala claims that he was forced to affirm the earlier SD, without giving any details yet as to who forced him and how.
The Malaysiakini report which appeared at 11.10am today, has it that the PC was then still underway.
Man, what a rollercoaster!

First, clean out all the online copies and reports of your SD. Recall back all today’s newspapers which report on your SD and finally – this is the most important of all – clear out everybody’s minds who have been corrupted by your previous SD so that nobody remembers any of those explosive revelations. Dear Haris,this thing is really getting out of hand.Only yesterday we are beginning to see some light in the tunnel and today we are told that light has been forcibly taken away.
The road to justice for Altantuya and to clean up the corrupted judiciary and police force is going to be very long and almost impossible now if UMNO still helm the top.
Nothing short of a change in the entire goverment machinery will put things right again.

From NST Online, it appears that Bala has retracted the entire SD, not only parts of it. He now says that “in no material time” did Razak tell him that Najib introduced Altantuya to him, or that they had sex, or that Najib asked Razak to take care of Altantuya. Basically, Bala is saying that the first SD is all untrue.
As I think I’m still unfit to comment on the real issue at hand, let me just say that I’m stunned at the speed that the MSM online portals are updating their news on this one. Seems like the speed of light if compared with yesterday.

Been reading much but first time writing in – out of disgust, like most. This kind of hole has that tendency to get bigger and tighter at the same time! Especially when you try to patch it or cover it up.
If he was under duress by the powers that be, perhaps I can understand how he would have succumbed to making that SD. Instead, to claim to be under duress by whoever else to make a SD IMPLICATING the likes of the DPM and the powers that be, I think nobody in their right mind would DARE do it, unless, there is some truth (if not all). You would have much more to lose when you do. Even with the “truth and guts” to implicate DPM, one can so easily and perhaps shakily retract, to succumb to higher powers.
We would have to wait for “further evidence” hinted at by DSAI. As this drama unfolds, the nation cringes in pain (of all kind). The world focus on us and laughs while the Mongolians shake their heads in utter disbelief. What mockery.

An SD is a declaration made under oath. And I believe that there should be serious implications for false declarations. Am I right? What would the proper procedures be from hereon?

The legal implications of the second SD are that, without more, Bala would on the face of it have commited an offence by swearing out the first SD.
Unless the veracity of the second SD is to be thoroughly investigated by the police to ascertain its correctness, and not immediately treated as the correct one, it would follow that Bala should be charged with an offence under the Oaths and Affirmations Act.

C’est tres bizarre.
Seems like a case of “compelled to say that he is ccompelled”. Sheesh. 1st (purported) compulsion versus 2nd (most likely) compulsion. Which is more probable, dear readers?
Was he dragged to Anwar’s PC? Was a gun put to his forehead there? He answered press’ questions calmly, did he not? Did he in any way look like he was under duress?

Whatever. Najib’s image, as far as I am concerned, has been irreparably damaged. The last nails on the coffin are his laughable statements.

Give me a break. 10As scholars often do not have a chance in hell in getting one from PSD and we are expected to believe that this Saiful chap will be considered for one, by the DPM office, no less?
DPM said that Saiful came to see him personally, all distraught and hand wringing. Goodness, since when did our DPM part time as an Aunt Agony and give advice on what to do when one is buggered?

Saudara Haris, It is funny how Malaysians easily forget that Bala had given evidence in Court on 4/6/2007 and his evidence had been splashed all over the papers and quoted almost verbatim by the press. Never at any stage during questioning and cross by the TPR or by the Defence lawyers did Bala ever refer to the DPM’s involvement. His sole reason to now make the SD and withdraw reference to DPM one year later right after prosecution case is closed clearly shows that the PI has other agenda in mind or has been made a pawn in the Political race by certain quarters.
I hope he has got his two cents worth and pray hard that no contempt proceedings be brought against him.

Which SD to believe? Let’s just think on the basis of probabilities
Who has the power to put him under duress in the first instance? I’ve heard some intimate his lawyer which must be a joke! PKR or Anwar? Unlikely and even if so, couldn’t he just go to the police?
But who has the power to put him under duress to retract it? He made allegations against a powerful politician occupying the second highest office in the land with all the state resources at his command. The power is certainly there and he would have nobody to turn to.
In his second SD, all references to the powerful figure was expunged.
So was he under duress to file the first SD or under duress to retract it?

The part on the SD that puzzled me was that it appears to contain some “hearsay” which would be difficult to collaborate. The other item that really puzzled me was why did he add the part about Altantuya liking anal sex? How would that give the SD more credibility? Just by having a sexual relation is bad enough. Having anal sex does not make it worse, unless it is to make it sensational, don’t you think?

This is an absolute intimidation to surpress the truth and there needs to be something that we, the rakyat, can do to ensure that this does not just fall off the table.
If anyone were to be charged, it should be the IGP/ Najib & AG. This is the actual meaning of corruption of the HIGHEST level.

Quite difficult to try and grasp what Malik is trying to say. My understanding is that if B tells C what A told B, then C’s evidence of what A had told B is hearsay and is not admissable unless it can be collaborated by direct evidence. Conviction by circumstantial evidence is very rare, and I remember the famous Sunny Ang’s case. So unless there is some direct evidence to collaborate what the PI had heard from ARB, he is treading on dangerous grounds, isn’t he?
Anyway, this SD and counter SD is not good for the country. Our civil services machinery is almost grinding to a halt. As the story goes, how do you know that a politician is lying? His mouth moved.

They may say Bala made the SD under duress. What about Raja Petra’s? Also under duress? Whatever you say if it is truth will be shot down, am I not right? Why, because the truth hurts too much!

Americk Singh Sidhu’s Press Statement, being made in his capacity as an Advocate and Solicitor of the High Court of Malaya, in regard to the preparation and attestation of the Statutory Declaration of P. Balasubramaniam of the 1st of July 2008 is as worthy of credit in a Malaysian court of law as any other Statutory Declaration. The police must investigate that too in order to arrive at the truth of the matter.

For 50 years of SHIT governing by the UMNOPUTRAS, Enough Is Enough. How are we supposed to endorsed or continue to except these UMNOPUTRAS, who are rotten to the core, to continue governing our country???
For all Malaysians living in Malaysia, everyone knows for a fact, so don’t lie to ourselves, that the whole bloody system of, the civil servants, the judiciary, the GOV.link businesses, and right up to the DPM, PM and even their family members, are all CORRUPTED TO THE CORE in one way or another.
The question is: Should we continue to let this bunch of PIGS rule over us? Should we continue to let these ANIMALS continue to insult our integrity, and insult our intelligience? Should we the RAKYAT continue to let ourselves be manupilated by these DEVILS?
I think it’s time to put a stop to all this, and prevent our country from degenerating into another Myanmar or Zimbabwe. We must all start to UNITE, regardless of race or religion, as one people with one voice, AGAINST these GANGSTERS, THE UMNOPUTRAS(& also their BNPUTRA DOGS), who DICTATES, ROBS, INSULTS and SODOMISES the RAKYAT.
I don’t see a federal government governing the country and I don’t see the civil servants carrying out their civic duties. What I am seeing, hearing and experiencing, is a bunch of UMNOPUTRA MAFIA and GANGSTERS trying to exert control over the people. What I am seeing is the UMNOPUTRAS trying to flex their muscles, DICTATING, ROBBING, BULLYING, INTIMIDATING, INSULTING, THE RAKYAT. Is this the type of future we want for our children and their childrens???
Honestly, I for one do not see ANWAR as angel, but in him I see a HOPE FOR CHANGE, a GOOD OPPORTUNITY THAT SHOULD NOT BE MISSED and HOPE FOR THE BETTER FUTURE of the country. For now he is the key to installing CHECK and BALANCE in the country, as we all know this is important, as POWER CORRUPTS AND ABSOLUTE POWER CORRUPTS ABSOLUTELY. And we must not forget that we the RAKYAT are at all times their BOSSES, and shall be the ones to DICTATE when to hire of fire the very people we see fit to manage our country. So if ANWAR, given a chance by the RAKYAT, does not perform. We the RAKYAT will give him the BOOT. So as the boss(THE RAKYAT), we hire him(ANWAR) because he is at this moment useful to us. But if he doesn’t perform his duties well or become useless we will then kick him out. Once this CHECK AND BALANCE factor is installed, DEMOCRACY will take over, then and only then will we advance together as a NATION.
We the RAKYAT must UNITE and reclaim our country from the UMNOPUTRAS and BNPUTRAS. We the RAKYAT regardless of our race or religion, owe it to our children and children’s children, to put a stop to all this POLITICAL GANGSTERISM happening in this country that we so love. We the Rakyat must ensure that HARMONY, PEACE AND DEMOCRACY PREVAILS for our own future and the future generations to come.
