If Wong Chun Wai’s ‘Race against time for reforms’ in his On The Beat column on 13th July didn’t touch on one matter of such great significance to this nation, one could just laugh it off as a case of WCW having difficulty shaking of an old habit of spin-doctoring on orders from up above.
That matter of great importance is the reforms to the judiciary.
Speaking of the recently announced two-year transition period before Pak Lah hands over UMNO to Najib, WCW writes :
‘…those who expect Abdullah to be an ineffective PM would be wrong. He has told his supporters and friends that he would devote his next two years to reforms, which he has committed to the rakyat…From reforms in the judiciary to fighting corruption, he would be fighting against time to make all the positive changes – and in the process make it easier for Najib when he takes over…The setting up of an independent inquiry into the VK Lingam video clip issue hurt Abdullah in the general election. The incident took place during the administration of his predecessor but despite the pressure from some quarters, Abdullah went ahead with the setting up of the panel.
I do not share WCW’s confidence.
On 18th April, in his ‘Delivering justice, renewing trust’ speech, Pak Lah conceded :
‘…No nation can call itself fair and just without an efficient and trusted judiciary. By “trusted”, I mean a judiciary that delivers justice and is seen to deliver justice…the fact is, we can no longer leave such an important institution to hope and chance. The system must have built-in safeguards to prevent potential abuse and it must have a process that will convincingly identify the best legal minds in the country to join the judiciary…Therefore, the Government proposes a change to make the process of nominating, appointing and promoting judges more transparent and representative…The process to bring about this change will begin now and I assure all of you here today that consultation on the workings and the structure of the Commission will involve primary stakeholders. All will have a chance to provide their input to the Government.
The process would begin ‘now’, he said, and consultations would involve ‘primary stakeholders’?
Who are these ‘primary stakeholders’?
It would seem, only UMNO.
On 19th June, 2 months after Pak Lah’s grand speech, Malaysianinsider reported that Umno ministers were not in favour of Zaid’s proposal for the setting up of the Judicial Commission for the appointment and promotion of judges.
What did Zaid propose that these ‘primary stakeholders’ found so unacceptable?
Quoting from that Malaysianinsider report, ‘Under the plan put forward, the commission would consist of 13 members. After deliberations, they would offer the PM a list of candidates for appointment to the Bench. This is a marked change from the current system where the list of candidates is drawn up by the chief justice’.
The following concerns of those stakeholders can be culled from the Malaysianinsider report.
- Not agreeable with the presence of former judges and lawyers on the proposed commission.
- PM’s power of appointment of judges will be usurped.
- Loss of Malay control over the judiciary.
- Top judicial post may go to a non-Malay.
Note that there have not been any reports of non-UMNO politicians objecting to Zaid’s proposals.
Are the concerns of these UMNO stakeholders for real or a mere smokescreen?
On 7th May, YB Lim Kit Siang posed the following challenge to Pak Lah in his blog :
‘In the last Parliament, I had questioned the fast-track elevation of Tan Sri Zaki Tun Azmi in the judiciary, with his unprecedented triple jump to become Federal Court judge last September without ever being a High Court or Court of Appeal judge, then quadruple jump in three months as Court of Appeal President, and whether this is to be followed by his quintuple jump in a matter of a year to become the next Chief Justice when Datuk Abdul Hamid Mohamed steps down from the topmost judicial post in October?
Is the Prime Minister prepared to make a public commitment that the appointment of the next Chief Justice will be first referred to the Judicial Appointments Commission which he has agreed to set up?’
Current CJ Abdul Hamid Mohamed is due to retire in September this year.
Who’s in line for the job?
Without the 13-man commission, Pak Lah calls the shots.
September, last year, Zaki was handpicked by Pak Lah to first leapfrog into the Federal Court and then slither into the seat of the President of the Court of Appeal.
Pak Lah may have had good reason to once again overlook Zaki’s colourful antecedents, but would a 13-man commission , in looking to fill that vacancy come September, be less charitable and look to some other candidate whose resume does not include transacting an illegal marriage by a Thai qadhi operating out of jurisdiction in a textile shop in Perlis to a woman almost half his age, then setting the marriage certificate ablaze in the hope that the first wife would not stumble upon this surreptitious union, only to later rely on the fact of this illegality to annul that marriage? Or would such a commission have to sadly report back that there are no more good men left in the judiciary?
And speaking of good men, were there none in cabinet who could rise to the occasion when Zaid’s proposals were shot down by the UMNO stakeholders?

How long will a good man like Zaid stay on to do his job of reforming the Judiciary when his proposals are shot down for the most sorry of reasons? Or will he be reduced to impotent frustration till he quits? Where was the reformist Prime Minister when he was needed to back up his Law Minister in the Cabinet? Time is indeed running out for judicial reform. The Judicial Appointments Commission very likely will be stillborn given its problematic race tinted reception at Cabinet level.

About the commission. I read on Malik Imtiaz’ blog about a debate between Nazri and Zaid a couple of years back organised by the Bar Council on the proposal for the setting up of a commission to appoint judges, where the commission would send in the names to the CJ, and if the CJ doesn’t approve, he has to have a written reason. A somewhat “full” account of debate can be found HERE
Back then, Nazri disapproved of the Parliament and Cabinet having anything to do with the setting up of the commission because he said that it would be tantamount to the executive interfering with the judiciary. So he simply refused to budge, and said that the suggestion of the setting up of the judges appointment commission could only come from the judiciary themselves.
It may be slightly different now, since the proposal is setting up a commission to appoint the CJ, which is done by the PM. (I may be wrong.)
But all the same, it seems that from back in 2007, and again now, the Cabinet has found ways and excuses to undermine the importance of having an accountable judiciary, and a transparent methodology of the appointments and promotions of judges.

YB Lim disclosed that the PMD Minister Zaid answered in one of his parliamentary question that such a commission will not be visualized before next CJ is appointed…
I quite like YB Lim’s response — The nation will soon have its first ever UMNO CJ…
Quite true… they will let Zaki take over the CJ position before reforming the judiciary… errrrmmm… that’s if they really want to reform the judiciary…
With Zaki being CJ… the Prime Minister will certainly have more good years in his safe and warm bed…

There are quite a number of judges who are really honest and had decided without fear nor favour . However they are being sidelined because of their strong principles like Justice Hishamuddin Yunus in the high Court , Abd Malik Ishak and Gopal Sri Ram in the Court of Appeal and Zakaria Ariffin of the Federal Court . However the new Judicial Commissioners appointed by the disgraced Fairus had yet to prove their worth except for Zaidi of Kuala Trengganu . While the rest of his Lordships , I reserved my comments . Any lawyer worth his silk will tell you , what they really do in their courts !

Your piece of analysis is good. It goes to show how much how much influence UMNO has in the entire administration. It’s obvious at no time UMNO refer important decisions to its’ non-malay partners.
On Pak Lah, he never seems to care about his words and promises. Since he has come into a PM he has been issuing statements after statements to ensure they remain mere statements. It reminds me “NATO” @ No Action Talk Only.

Honestly I am now beginning to wonder if all these very clever analysis of events and what some smart asses say and write is necessarily deserved. I reckon considering the kind of crap WCW and all the other spin doctors and politicians write, and will keep writing, and say, only deserves a “f*** **u”. Anything more than that and it makes me wonder if I might be a fool afterall. It is not like as if they don’t already know that theirs is no more the final word on any subject. I think it is about time they get the kind of shit on their faces that they have well deserved. All these idiots get away with bloody murder only because they are a Datuk WCW or someone like that, and being typically very nice people (I am refering to us of course) we spare them the litany of vulgarity that we all are mostly well versed in. Do these people deserve the freshness and the deep insights of my thinking over matters they have commented on? I don’t think so. Indeed they deserve the abuse and the litany of vulgar language you’ll find in some market places.
But of course there will be people who think they have been ordained to make judgements of those who are inclind towards such language and approaches. But really, like some one has said, being good men and we try remaining good men and treat these scoundrals like as if they are the Pope, it is evil that will prevail. Fact is people like WCW are the reason for all teh evil in Malaysia that has prevailed as they have been part and parcel of the masking of the truth from us and they actively contribute and participate in ensuring evil perpertuates. Our nation’s sleeping beauty has stumbled on the best formula to drag him, though unwillingly, to the pits of international ridicule and political oblivion.
Just imagine. How can a rational human being promote a person to the second highest position in the judiciary by the ignoble means of double and triple jump promotions when that character is a tainted one in the eyes of the law?
Was he elevated to the exalted position because he was a poligamous judge who could invalidate his marriage just by destroying the evidence? Now he is at the threshold of becoming the number one man in the judiciary.
What an irony? A known and proven destroyer of evidence is about to be anointed as the CJ of Malaysia. Anything is possible in Bolehland!
Another component in the unbelievable Sleepy Lah’s formula is the appointment of a known actor in the Lingamgate opera as a minister in the cabinet. He seems to go for everything that is tainted.
The formula would not be complete, if the Mike Tyson character is not included in the cabinet even though the rakyat did not elect him.
One good thing about our Sleepy Head is that he portrays himself as pious and grateful. He shows his gratitude to the PIG and the dubious AG by not suspending them for their alleged tampering of evidence in Anwar’s case during the mamak’s reign of insidious corruption and cronyism.
Mentioning the role of Najis and his spouse in the Alantuya’s murder case is irrelevant as everyone knows why Sleepy wants him around. He is the buffer who will absorb everything thrown at Sleepy and in the end commit political suicide.
He has another catalyst in his formula to bring the demise of BN and himself in the person of Botak, the directionless Home Affairs Minister.
With the above personalities thrown in the cauldron, Sleepy Lah does not need DSAI to show him the exit come September or earlier.

He burnt his second wife marriage certificate; I don’t even have my own marriage certificate. I’ve been married for decades. Do you? Perhaps if you get married recently you might.
Did he commit a crime? No. So why judge him by this. Anything that says un-ethical person cannot be CJ. How do you judge or weigh ethics, can you use it in a court of law.
I think the biggest issue here is there are no specific criteria for judge’s appointment, promotion or even in selecting a CJ. Everything is quite abstract.
As a result, system is beaten. And this is what is happening right now.
Will setting up a 13-man commission (or woman) solve this issue? No. I don’t think so.
Who appoints this 13 special man? What if all the 13 man are influence by the exec. How to ensure this does not happen? I can tell you that even if you set 130-man commission, its not going to make any difference. The system can be beaten.
Hey, I leave you with a question to ponder, why is there a need for a Law Minister in the first place?

I failed to understand your arguement that burning a marrige cert is not a crime and hence we should not judge Zaki by this act.
By your reasoning, many people can go about burning their marriage certs if they want to opt out.Then,why have marriage certs in the first place?
Days after the 080308 tsunami,the defeated state govts destroyed files and documents to erase evidences of their past misdeeds.
So,how safe are those court files and documents under Zaki?For a man to burn his own marriage cert to hide evidence,don’t you think he will do the same to some files and documents under his jurisdiction,especially those not very beneficial to UMNO?

OK,first thing first.A marriage cert is issued by the govt to a married couple.So,can you simply set it ablaze?I don’t know under which section it is a crime but I knew it was wrong to burn a cert issued by the govt.It should be kept in a safe deposit box together with other important stuff like your passport,birth certificate etc.
You said you have been married for decades without a marriage cert.Perhaps you belong to those generation who can’t see the importance of this document.Do your spouse a favour by getting one asap.

Yes, WE are all concerned about the “Highest” office of the nation’s Judiciary Institution which had seen Illustrious, Honourable & Incorruptible personalities like the late Tan Sri Kadir, Tun Azmi, Tun Suffian, etc who had upheld the office with “Dignity, Honour & without Fear or Favour” from the Powers-that-be.
Yes, I had been fortunate enough to have met & spoken to those great “TRUE Towering Malaysians” in my younger days !
Yes, THEY were all “Powerful, Authoritative but FAIR” in discharging their “Principled & Unbiased” duties all the way to up to the Highest office in the Judiciary, & Tan Sri Kadir later became the Law Minister.
Yet they were very “Humble” individuals !
We have to restore that Institution to its “Original” status to uphold our Constitution & Justice by the “Rule of Law” with only the “Best” Honourable & Incorruptible personalities.
But thereagain…we are in Bolehland with the daily kindergarten “cat & mouse, hide & seek” saga requiring manipulations & pervertion of the “Rule of Law”…so ofcourse, they will need their ex-UMNO apointee.
This nation’s & the rayaat’s plight vs their personal “NEEDS & GREED”…
This great nation & its Downtrodden rayaat gets screwed again & again…..what’s new ????
We are now at a CROSSROADS…and YOU have a CHOICE…
