Shah Alam High Court Judge Mohd Zaki Md Yasin this morning acquitted Abdul Razak Baginda of the charge of abetment in the murder of Altantuya Shaaribuu.
The judge however ordered that the two other accused, Chief Inspector Azilah Hadri and Corporal Sirul Azha Umar, enter their defence to a charge of murdering Altantuya.

My prediction was spot on. Next the court will find both cops guilty and sentenced to death. Since both faces were unknown to public, they will be replaced by death-row prisoners to be hung. Both cops will be given new identity and start a new life elsewhere.

My question has always been, what have the 2 cops got to gain from the killing if they acted on their own?! It doesn’t seem like any of the 2 or both have personal motive to kill her. Unlike RB… or if they were instructed by people who has authority over them…

If Baginda is acquitted, what now then is the motive of the other 2 ?
In any murder charge you have to show the motive.
The prosecution cannot now say that the 2 suddenly woke up one day and decided to blow off a Mongolian beauty.
So prosecution may now have to amend the charge to one of culpable homicide not amounting to murder.

This is the type of judiciary system once again proven to the international eyes that we Bolehland has our own pattern of democracy! And no one is allowed to meddle with our internal affairs!
Whilst it’s expected, we do not expect they will do it in such a blatant and uncouth manner to openly unveil the loin cloth to expose the utterly stinking pile, suck in and suck dry the essence of justice totally depleted and gushing out now is the eerie blood fluke, the injustice prevail! The day when the alleged abet murderer is acquitted, is the day Malaysian justice is being sanctioned the verdict of guilty and sentenced to life imprisonment in the Pandora Box!
Peoples around the world with particular inclusion of the victim’s family and clans, their countrymen and the global peace loving humankind, how will they look at us and the image of our Nation will not at all be tainted a brutal, uncivilized and undemocratically ruled by terrorists?!
Perhaps the acquittal of Razak Baginda is a first trial of our newly appointed CJ who has just sworn in days ago, to test his plan for the reform list, the priority is given to paint it more black our judiciary system or to purify it! Or he being highly recommended by AAB will merely prove he is a wonderful reformist resourceful in the form of asking for more money to develop only the hardware and facilities, justice remains as it is!
It will only be acceptable and convincing when the Court’s release of Razak Baginda is the beginning of a new trial and proper justice should be served on the criminals regardless who they are and in what positions they are in, testament of ‘no one is above the law’ as propagated and pronounced!…………

This acquittal was already been confirmed in November 2006. We have been watching a very sick drama performed by devils. This episode reminds me of the acquittal of O.J.Simpson’s murder charge. And this will definitely have the same ending. God is Great.

It appears that many believed RB should be made to enter his defence, which would mean that he gave the order to have Altantuya killed or abetted in the killing. I have not been following closely the case so perhaps someone who have been following can enlighten whether it was proven in court that RB had prior knowledge of the killing. Otherwise, we should not make RB a proxy for DPM. Or maybe we want his defence to be entered so that he can spill the beans?
Conviction through circumstantial evidence is very rare.

What is the moral of the story for the two killers? Worth it? Some people don’t have life. They believe their life belonged to someone else. I heard that Sultan of Brunei has personal army who can hand carry him to run miles and miles away in the worst situation. Such… is the life of the servant.

A MURDER WITHOUT A MOTIVE?
Chief Inspector Azilah Hadri and Cpl Sirul Azhar Umar, have been called to defend themselves against the charge of murdering Altantuya Shaariibuu.
Very Interesting?
In any murder trial, the prosecution will have to prove two important ingredients without a shred of doubt to obtain a conviction .
Was there premeditation, and secondly, was there a motive for the killing? Has the prosecution established these two ingredients? We will have to wait till we read the judgement.
Meanwhile let‘s speculate.
Prior to the killing, Altantuya was a total stranger to the two cops. Who led them to her? How did they get to know her? Why did they abduct her? Why the need to kill her?
Now, how will the duo defend themselves since the only link between the victim and them, Abdul Razak Baginda, has since been acquitted on a (‘tentative’) charge of abetting them?
My prediction. Two probabilities.

Even if the both UTK officers were sentenced to gallow, it will not satisfy the local and international audience.
Malaysia judge must give the answers to
1. Why the UTK officer have the intention to kill Altantuya? Is it due to rob, rape or under command?
(We all know that they are under command of unknown mastermind. The 2 UTK does not have any relationship with Altantuya from beginning.)
2. If they are under command who is the mastermind? Does it mean that only those who carry out the job is considered murderer? Mastermind can be put into irrelevant list?
3. Should the case be closed? We all know the case is far from end. The police should continue investigation and find out all possible new evidence.
Bala should be detained using Interpol for being missing before the actual case disclosed.
The prosecutors should feel shame for failing to carry out proper investigation.
The judges should feel shame for failing to upright the justice.
This only will encourage more murderer by mastermind and walk away without being caught.

Knew RB when he was a lecturing and from my interaction with him, I do not believe he was involved in the murder of Atantuya or even dared to ask someone to murder her. I believe his case is only on having an affair with Atantuya and not keeping to the promise of the sales commission. He is not the type to get involved in something drastic.

Motive of the crime?
The two UTK officers would perhaps say that they were just escorting Altantuya away from Razak Baginda’s residence. They stopped somewhere and while waiting for further instructions, they got bored and started playing with their guns tossing it up in the air while joking with each other. Accidentally one gunshot was fired, hit Altantuya on the head and killed her. Panicked, and not knowing what to do, they decided to dispose off the body with C4 explosives.
How’s that for a storyline? Guilty still but no one else is implicated.

Let us not be emotional over Razak’s acquittal, and let us view it from the criminal justice system angle. Before I proceed, I must state that I am not a big fan of Razak, and I am not interested in any conspiracy theory in relation to this matter. The following is my personal view, and are based on my own observation.
We must view it with an open mind. Now, lets look at the prosecution’s case in totality. Analyze the evidence adduced by the prosecution in their case. Are the evidence enough to establish a prima facie case against Razak. I am writing this as a third party without any bias towards anybody… and I am of the view that there were not enough evidence to establish prima facie case against razak.
As we all know, Razak was charged with conspiracy for his alleged part in the murder. What are the evidence to prove that razak conspired with the other co-accused? The fact that the deceased harassed razak? the fact that razak sough help from Musa Safri? the meeting between azilah and razak? Did the prosecution adduce any evidence of instruction to commit the murder from razak? I respectfully think that these evidence did not create any nexus between razak and the murder..
There are too many doubts raised by the defence in the prosecution’s case, and these doubts remain unanswered. In order to establish prima facie case, the prosecution should at least link razak to the instruction to commit the murder, and not just rely on circumstantial evidence as stated above.
Even if the Court finds that there is a prima facie case for Razak to answer, do you seriously think that the prosecution can pass the “beyond reasonable doubt” test? I dont think so.. even during prosecution’s case, there are too many doubts that surround the prosecution’s case. I m not suggesting that the prosecution did a shoddy job, nor am I suggesting that the police did a shoddy investigation.. Maybe that are the best evidence they can get..
So, let us carry on with our lives, and not have any prejudice against anybody involved in this case.. The learned Judge decided the case based on evidence available before him, the prosecution presented the best evidence they can, the police investigated the case the best they could… and let the poor razak get on with his life…

With Razak Baginda off the hook, the prosecution will have a very difficult job to nail down the motive the cop and the soldier had to kill the lass.
Su asked “So now, who then gave the orders to the two accused, to do what they are accused of doing?”. The accused are going to plead not guilty, they didn’t do it. So the question of who gave the orders does not even arise.
My prediction is the accused will walk free.

What does Shamsul mean by saying let’s be objective? Witnesses and SDs have been wiped out clean from the case. Prima facie? What about the evidence of the weapon (C4) which is used? Why would the 2 cops have the authority to obtain the C4? What’s their mens rea? Simple logics and common sense: The girl only knew one guy in M’sia which is Baginda… This guy is close to someone who has the authority to command C4s to be used. What’s the motive of the cops other than delivering an order?
Judges have been sent to boot camps by that Mamak and Im not surprised that the present gov will let these “trained judges” to preside in cases like these.
I saw this news on BBC and Jazeera last night. Total embarassment. Now, the foreign media is going to speculate themselves on this freed political analyst who is acquitted. How much more does M’sia wants to make itself known as a corrupted, racist, unjust country to the world?
They try to put up a wayang kulit on how they’ll catch the small fish in an attempt to cover up for the big fishes. I hope that the real killers who seem like they may not be convicted in M’sia will be punished by God for vicious killing of a being, who is a daughter, a mother and sister and friend. No female deserves to die like that.

I made it clear in the first paragraph of my comment earlier that I am not a big fan of Razak, and I also wish to state here that I am not a supporter of BN either, and that I am a political free thinker.
However, we should draw a fine line to separate politics, and all the conspiracy theory surrounding the case with the judgment of the Court.
What I meant in my earlier comment is that politics apart, conspiracy theory apart, I am of the view that there was not enough evidence to establish a prima facie case against razak. Diana, please study the case carefully, ask yourself, and answer truthfully, do you seriously think that there was any evidence to even suggest that razak gave the instruction to murder the deceased.. was there even any evidence to show that razak abbetted in the murder?
Dont you think that there are doubts in the prosecution’s case? These doubts remain unanswered at the close of prosecution’s case. How do you expect the learned Judge to order razak to enter defence?
We may have differences in our view, but at the end of the day, we must respect the finding of the Court. Not everything in life is about politics.. Finally diana, please bear this in mind.. “its better to acquit 10 guilty men, rather than to convict and sentence 1 guilty man”
