Malaysiakini reports today that the prosecution will not be appealing against the acquittal of Abdul Razak Bsginda without his being ordered to enter his defence.
It is reported that DPP Tun Majid Tun Hamzah said that the court had made a finding of fact and he confirmed that the prosecution would not file an appeal.
I’ve just called a few lawyer friends and all have confirmed the same thing : we all cannot recall an instance where there has been an acquittal in a murder trial and the prosecution have not appealed the acquittal.
In fact, when Justice Hamid Embong, then judge of the High Court, acquitted the accused in the trial for the murder of Norita Shamsuddin on 12th August, 2004, without requiring the accused to first enter his defence, the prosecution appealed.
And is not an acquittal, in a murder trial after the close of the prosecution case and without ordering the accused to enter his defence, invariably a finding of law that the prosecution has failed to establish a prima facie case, that finding of law turning on the trial judge’s consideration of the evidence of fact and, where admitted, opinion?
Did not Justice Hamid Embong make several findings of fact before he arrived at his decision, in law, that the prosecution had failed to establish a prima facie case?
So how different is the acquittal in the Razak Baginda case with that of the accused in the Norita case, that one should be appealed and the other not?

1) Judge not interested to find out who deleted the immigration record.
2) Some important testomy was disallowed by both prosecution and defence.
3) The earlier lawyer discharged himself saying too much interference.
4) Shaffe’s sms text.
5) Judge Segera was replaced by another.
6) One affidavit implicating a vip now no longer an issue.
Now prosecution not interested to appeal. Surprised? When everyone was objecting Fairus’s extension Zaki was parachuted to FC and became COA’s president. Was there any convention then? but when he was appointed the rule thought it fit to say they do not want to disturb the convention.
Wake up..nothing going to change. They only change we can expect is hopefully the next GE we can totally wipe out BN. Until then nothing going to change.
If not for the mongolian government involvement I wonder if anyone would even know Altanyu ever existed or got murdered in Mlaysia.

Remember that sms exchange that was reported to come from Najib to Baginda’s legal counsel? Something like it was a mere ‘ tentative charge’? The answer is all there. What is there more to say? Window dressing is a specialty of UMNO. What do the people of Mongolia now think of Malaysia? Justice is a very elusive concept in Malaysia, depending on who you are, whom you know. Hopefully, the Lord up there is watching with his divine hands.

Every other thing they want to appeal….Anwar’s case, RPK’s release…….but MURDER…..no appeal. Kudos to Najib. You did a great job here.

Actually I already predicted this outcome, in BolehLand , everything is possible if you are in power.
We should now pressure the authority to find the “real person(s)” behind this gruesome murder, surely the two policemen can’t be waking up one morning and decided to kill Altantuya…

Am not at all surprised at this wholly expected acquittal because the democratic principle, that everyone is equal before the rule of law, appears to have, allegedly, died in Malaysia sometime in the nineteen eighties due to it being, allegedly, deliberately killed-off like our poor, shot in the head at point-blank range and then obliterated to smithereens with C4, Altantuya.
However, I have a strange feeling that poor obliterated Altantuya may personally intervene and settle matters relating to her justice directly with her murderers and any other abetter/s and accomplices in this case, especially since the presumed-innocent and so now acquitted Abdul Razak Baginda has stated openly that she was…er…very persistent at harassing him for money while she was alive.
Based on that telling personal snippet, one can’t help imagining that someone who is alleged to have been so persistent at stalking someone for cash while she was alive may also be….er…equally persistent at demanding some retributive justice (through haunting as a stalking hantu perhaps?) now that she has been shot dead, blown-up to pieces and despatched off to that so-called nether world without her consent.
Bomoh or some voodoo anyone?

Normally, prosectors try their level best to paint the defence into a corner. In this instance, the prosecution, led by a ******* named Majid, willing shoots itself in the foot so that the defence can get away scot free. In fact, Majid was seen smiling and appeared pleased as punch when the court released Razak. Mission accomplished. Now we know why the law is an ass in good old Malaysia. Malaysia Boleh. Justice Boleh. Semua kautim.

The verdict was written even before the trial commenced. It’s so blatant and they are telling the world with their middle finger, “So what. This is our Justice.”
Didn’t Najib say this is only a tentative charge?
Going by this Malay Supremacy ideology, do you think the system will hang a Malay for killing a Mongolian women, whom they classify as kafir, immoral and hell bound?

This is a huge case and the prosecution seemed to lost interest and have no will. They seemed to be more happy not to appeal. Nobody i spoke to is happy at the AG’s decision. Would Razak now sue the government back? Surely not.

Just a bit bore why they the movie drag too long, obvious they want to relieve him. In fact, he is not the real murderer. Albeit the acquittal is an unjustic but in Bolehland just take it easy lar…….

Didn’t we expect that Razxak Baginda will be let off? The prosecution from day one has worked towards that end. From the way the case is being handled, I expect the two policemen to be released too.
