
The Child Act, 2001 defines ‘child’ to be anyone below the age of 18 years.
Section 31(1)(a) of that Act makes it an offence if any person who, being a person having the care of a child, abuses, neglects, abandons or exposes the child in a manner likely to cause him physical or emotional injury or causes or permits him to be so abused, neglected, abandoned or exposed.
Section 32 of the same Act provides that it is an offence for any person who causes or procures any child or, being a person having the care of a child, allows that child to be on any street, premises or place for the purposes of
(a) begging, receiving alms, whether or not there is any pretence of singing, playing, performing or offering anything for sale; or
(b) carrying out illegal hawking, illegal lotteries, gambling or other illegal activities detrimental to the health and welfare of the child.

On 23rd August, 2008, on our way up to Permatang Pauh for the by-election, we stopped at the Tapah lay-by for some R & R.
Whilst most ended up at the KFC restaurant, Bernard, Marina and I headed to the main food court for some teh tarik and coffee.
Whilst having our drinks, this young child aged 13 approached us.

I cannot remember his name, but he introduced himself and asked if we would help his religious school by buying some poster calendar that he was selling for RM10.00.
I asked if he had authority to sell this on behalf of his school and he promptly produced a letter of authorisation from the school.

I inquired how frequently he had to go out and how many students were involved.
He responded that all students were required to participate in this exercise and whilst he would not say how frequently he had to approach the public to sell the school’s wares, he said it was ‘kerap’.

Malaysiakini reports that fifteen-year-old JERIT cyclist S Thivyakumar ‘lambasted the cops for thinking that the teenagers were “too young” to take care of themselves and join Jerit’s campaign’.“They keep asking us whether we know why we are here… of course we do!” he exclaimed. “We are here to fight for a better life… and we are not young children that every time we want to go to the toilet, one of them has to accompany us,” he said.
Thivyakumar is reported to have said that all 27 underaged cyclists were packed together in a small room and given only mats to sleep on the night they were detained at the Rawang police station.
Another young JERIT cyclist, Ravindran, stated that they were well-aware of the objectives of the campaign. “They think we are children and we do not know what is going on… but we grew up seeing how our parents struggle – how can we not know about it,” said the 17-year-old Ravindran.
The report also has it that cyclists claimed that the police did not care when they got wet during heavy rain yesterday. According to them, the area where they were detained before they were moved into the police station later in the night had began flooding due to the downpour.
“We ran out as it started flooding but the police and the FRUs forced us back in there,” said 16-year-old Danny.
“They then put a yellow tape around the area to keep us in,” said Danny.

Doesn’t S32a of the Child Act as it is now stands, make it illegal for say Brownies, Guides and Scouts to engage in the normal activities for which their movements are renowned the world over?

I’m pretty sure many retired and expired policemen and policewomen will not only be dumbfounded but wonder the wonders of this particular CPO of Selangor. After all, the IGP is no different…..maybe Tun Haniff can help to shed some light. I really pray for him for he knows not what he does……poor soul must be having nightmares scheming and deceiving, thinking and acting what to say and do each day without contradicting the earlier act. May the Good Lord forgive him…..

I think the youngsters, who were involved in this campaign, have much better sense and intelligence than this lying CPO. Obviously, Khalid’s motive was to create havoc to these fine young men, simply to gain cheap publicity and getting ‘Famous’ for a wrong reason.
It is frightening even to think that this is the sort of specimen, UMNO will choose to promote. An potential IGP in the making!!

I watched on TV where the Selangor CPO gave his statement and HIS VERSION of the exploitation of children, while on a fleeting glimpse of the Jerit Participants, why was the TV so irressponsible by not allowing them to give their statement!!
This is the very reason that many of us boycott the irresponsible MEDIA.

Child work has been going on in Malaysia for as far as I can remember. It was customary for students like me who studied in Chinese primary schools to go to the public and ask for donations, because the school often has insufficient funds to operate thanks to MCA. Does that make it O.K. because it was sanctioned by the school?
Go and arrest the ministers , principal and school teachers who made us go out and ask for donations then. They are STILL DOING IT my dear police chief.

Child exploitation charges wont stand up in court,simply because the parents of all participant under the age of 18 have signed letters of consent.
The requisite permits have also been applied for, the police were silent, and from what I read here there is tacit approval from the Labis OCPD.

DCP Khalids conclusion that the kids knew nothing is laughable, yeah right ! question them menacingly, then when they remain silent- cite ignorance and abuse.
Then there are other cops who are themselves UMNO members who are carrying out this intimidation, first they cited “complaints” that the cyclist were obstructing traffic, when told to reveal the source they shut up because they were none.
There are dirty cops who will do things to please their political masters.
Perhaps decent cops like the Labis OCPD are tired of PDRM’s name being tarnished by politicians.
It really makes them look stupid when a large segment of the population scream political interference, but the police have to deny citing public order and declare unconvincingly that they are neutral.
I am waiting for one honest cop, to resign Zaid Ibrahim style and expose the politicians who pressured them.
Because at the moment PDRM’s reputation is lower than junk bonds.
Frustrated they thought they could nail, Dr.Jayakumar on abusing the child act,now they have an egg on their faces when the good Dr said he has letters of parental consent.
There were then some churlish cops started stopping cyclist, in the pretext of checking for parental consent, this shows that they know they cant do anything if the kids had one.
Dr.Jayakumar and his wife Ranee are veteran social activists-they would have foreseen all these obstacles.
I commend the parents for allowing their kids to participate, to teach them from a young age not to tolerate injustices, and when they attain voting age hopefully they dont elect stupidly arrogant governments

Last Saturday morning I was waiting for my wife in my car while she went to buy some cakes from a shop in Cheras. I kept the engine running to enjoy the cool air from the air-cond unit. I heard someone knocking on the car window. There was this Indian boy hardly 5 years of age standing there saying things that I could not make out because of the car’s sound proofing. I turned down the window. He asked me to drive my car from the car park lot that I was in as he had to sweep off the pile of rubbish underneath my car. I drove my car to the next lot. I could not help but witness this boy and his 2 younger siblings helping his mother in sweeping the surrounding area. These 3 kids were doing a terrific job using brooms taller than their small body frames.
Is this child abuse or is this the local culture and values that we have all along been inculcating in our society…being helpful and filial to our parents?
The RM26,000 per day expenses incurred to maintain the PM’s official residence in Putrajaya (as reported in malaysiakini) would have bought 26,000 pieces of roti canai for 26,000 of such poor children everyday.

How many Charity Fund Raising Organizations are really licensed or permitted in this country?

Even in shopping malls, they have booths for fund raising or in the post office for some individuals.
If it is really a Islam country should this type of “jobs” be run by so many privates or even individuals?
Many of them are showing photos that they are taking care of a few handicapped children.
Does the Government have full monitor or know how many people are in need and have they been handled properly?
Has the Government been doing what they should?
