
Got calls from two sources a little before 5pm today to say that the family of A Kugan have just been given permission by the relevant authorities for a second post-mortem to be performed.
Nanda headed out to the University Hospital where it was understood the second autopsy was to be carried out.
Got one call from Nanda around 6pm. Informed that YB Gobind Singh, YB Sivarasa, YB Manikavasagam and lawyer Surendran together with family members of Kugan were at the hospital. Selangor CPO was now being ambivalent about whether the second post-mortem had been consented to. Seems that the earlier confirmation had been communicated orally by some senior police officer from the balai in Subang Jaya.
Just before 7pm, Nanda called again to say that its settled. Although the CPO was being difficult about the choice of pathologist, the family’s wishes have prevailed.
Their choice of pathologist will undertake the second autopsy tomorrow morning, 9am. Am told that members of the family and lawyers will be permitted to view the autopsy being done from the viewing gallery.
Nanda informed me that it is expected the autopsy will take anything between 5-8 hours after which the pathologist will have to write up his report.
Depending on the report, it may well be that Kugan may finally be laid to rest on Chinese New Year day.

1) According to Malaysian law, do we need a police permit to gather for the vigil?
We have been given to understand that the tarmac in front of the MBPJ building is the private property of MBPJ. As we understand the law, our vigils at the tarmac do not attract the requirements of section 27(2) of the Police Act, 1967 to first obtain a police permit.
2) What about Malaysians’ constitutional right to assemble peacefully? Still need permit?
The constitution allows parliament to restrict the exercise of this right for the purposes of public law and order
3) Why was the permit for the vigil not obtained at the last few vigils (hence the large police presence)? Didn’t request? Request denied?
We have never applied for or obtained a permit for any of the vigils. The permit obtained by Richard Yeoh was for MBPJ’s Mesra Rakyat effort, as I understand it. Richard has ceased to apply for the same, I think, after his last application some time back was rejected.
4) If a permit is required, who is responsible for applying for the permit? Does the permit have to be requested on a weekly basis?
As for as I am concerned, permit is not required.
If a permit for the vigil is required and cannot be obtained, please inform us so that we can make arrangements for our children to stay home.
As far as I am concerned, permit is not required and shall not be sought.

Lets hope the pathologist will conduct a proper autopsy and report what are facts and not what the police wants him to find out. Wouldn’t be surprised that the police may try to influence his findings. Nothing new anyway.

The CPO incidentally has not been professionally managing the police force and incident crisis control. Appears that he is very impartial. Good work for the PR lawyers to handle this important case till justice is done. I hope Malaysian of Indian nationality support what the PR lawyers concern and responsibility in discharging their duties especially YB Gobind Deo as their MP. To YB we vote you the second term.

It is amazing what the police can do. Look at the IGP and his face tells you that there is no aura of law and order. Look more like a crook. Same with the many vice-chancellors of our local universities. Thy don’t look like what they are suppose to represent.

The least that could be done is to restore justice to his loved ones.
Maximum punishment must be upon the perpetrators so that the “perpetrators wannabe” would have to think hard and harder before they commit such brutal acts.

The original doctor that conducted the post mortem should also be charged for falsifying a report. MACC should also investigate why the doctor falsified the post mortem report.
Let him be made an example to every other pathologist in Malaysia that they should never ever attempt to Falsify any post mortem reports

Surprisingly, the sleepy PeeAme, his deputy and the interior minister just keep quiet. It seems very unusual.
The best thing to do in order to calm the nerves of the people is to sack S Hammit, Musa, the Selangor CPO and the OCPD concerned.
They must be held accountable sine they have made the majority of the good cops suffer due to their incompetence in leading the force.

If the 2nd PM report significantly differs from the 1st, the 1st patholgist ought to explain how he came to the conclusion of “pulmonary oedema”. If he fails, his registration should be reviewed again by the Royal College/MMC and stripped-off if necessary to protect the best interest of the public.

1. Could an early 1st post-mortem affect or dilute a second attempt in ascertaining the true cause of death?
2. And, in case of any conflicting conclusions, what are the odds of determining which of the 2 is the probable cause?
3. Is there not a distinct possibility (or even a probability) that the 1st post-mortem may be conducted in such a deliberate manner as to eliminate a subsequent inconsistent finding in case there is any fraudulent motive?
These are academic questions for the not-so-faint-hearted.

If suspect do have existing all over the body injuries as shown in photos were in custody, he should first be send for checking with proof of medical report before he is sending to medic room(torture). If suspect died in custody with such injuries with highest state official trying to cover, sure there is interest benefit involve somewhere (because he no need to take such risk). Or it may be new politic tactic to provoke Indian to create chaos.
2nd.
If evidence is strong link to investigation brutally, the choice is to get some lower official admit the wrong (can easily find, plenty of big tummy in waiting). Then after few years behind bar, out with few hundred K waiting for them. That amount can easily raise with sponsor. Why AG ask the case to be classify ‘MURDER’?
Reason 1: Because to cut those who ever want to use the above tactic.
Reason 2: The tougher the case,the higher the price.
Reason 3: AG want high case such as C4 evaporating flesh and bones not this. Or otherwise…

Call me cynical, but suggest respectfully to Kuhan’s lawyers that they request relevant tissue samples from Kuhan be removed after the autopsy at the UMMC and be kept in safe storage for use in any potential further investigation by an independent forensics expert if this is proved to be necessary in future.
And my heart goes out to Kuhan’s grieving family.
Their beloved son’s life may probably have been seen by some of those pariah b**tards in the PRDM as being less equal to and so worth a lot less than some others.
