If Tsu Koon ever got tired of politics, the race-based kind or otherwise, and wanted to move on to something else, I always thought he would do well as a stand-up comedian.

In fact, quite a few in BN would do extremely well.

Koh Tsu KhoonI don’t mean to make fun of a person’s looks, but don’t you think that if he was slightly worked over in the studion, he could very well stand in as Malaysia’s own Mr. Bean?

Anyway, NSTonline today amply confirmed that Tsu Koon is definitely ‘funny man’ material.

In relation to the ongoing Kampung Lorong Buah Pala land dispute, Tsu Koon is reported to have rebuked Guan Eng for trying to pass the buck and said that the present CM of Penang should just get on with the job.

“When they (the current Penang state government) can’t do something, they will blame either the previous state or Federal Government. That is the trick of their trade”, Tsu Koon said.

Good one, Tsu Koon!

    Who planted the seed of corruption into the Malay psyche? Malays are by nature very gentle and polite. But when they become greedy they will be the worst breed of trash.

    Coming back to my original question: of course, it’s the MCA Chinese. They were the original corrupters of the Malays. In doing so they are willing to stab their own brothers, sisters, mothers and fathers in order to get their hands grubby with filthy lucre.

    Do you know why the MCA and Gerakan still want to remain in the BN fold? Because they are treated as special miniputras by UMNO. UMNO are willing to feed these greedy MCA and Gerakan Chinese and starve the ordinary Malays so that they can learn the secret of corruption.

    So beware you Pakatan leaders: never accept any MCA or any BN refugees with open arms. Just look at Chua Soi Lek. He was grumbling away and flirting of jumping ship. But when Najib offered him some crumbs he was again singing praises for BN.

    Anwar made the fatal mistake of trying to get 30 BN crooks to jump ship. They dallied and calculated the cost and finally decided not to jump. And Anwar got a load of mud splashing on his face and his sterling reputation was flushed into the sewers. So take this as a lesson, Pakatan.

      I think you have got it absolutely right. Pakatan ought not accept anyone who has achieved leadership status in BN. Accept grassroots members, fine, but not any of their leaders. Anwar I hope you now realise the folly of your actions in trying to entice the enemy into bed.

    If really Malaysia is all about pitching one race against another, the Chinese then should recognise the Trojan Horse that Koh is.

    The Kampung Buah Pala was supposed to be Trust Property. The State was supposed to be the Trustee. Well, at least that is what I recall reading somewhere.

    The beneficiaries were to be only life time beneficiaries with a right of occupation I presume.

    It is the Trust that needs to be examined to see what it is all about. What I cannot understand is why no one has asked to look at this Trust Deed. If indeed this is Trust Property it is the Trust Deed that gives the rights to the Trustee..the state…

    Does the Trustee have the right to dispose the trust property? If so how and what is to be done with the proceeds?

    I even read that the land was gifted. Well, if it was a Trust, I cannot see when or how it now has become a gift. Creating a Trust does not by itself tantamount to a gift.

    Hey, you lawyers and lawyer buroks, why aren’t you guys looking at it from this angle?

    In addition to my queries in my earlier posting, I quote from today’s “The Star Online”: “Arifin also confirmed that Kampung Buah Pala was sited on state leasehold land for 99 years, encompassed an area of 24,683.96 sq m (6.59 acres) and was earmarked for residential development.”

    It says State Leasehold land. Does that mean that the state only has a leasehold interest in the said property?

    In which case who owns the freehold? The Trust??

    Does the Trust permit the leasing of the land to the state so that the state then has, for the duration of the Lease, free rein over the land? Is this the manner in which the State enabled itself to facilitate the creation of wealth for some interim war lord?

    Question is, when was the leasehold created? Why was it created? Were these intentions intimated in the original Trust? Are the Developers going to be telling potential buyers that the freeholder in this land is a Trust?

    By the way, have anyone of you heard of such a thing as a state leasehold land? I always thought the state had the freehold interest and it issued leasehold titles.

    KTK lacks courage to admit responsibility for what he had done when he was CM regarding land deals. Perhaps he had not much of a choice then. He was put there by his ‘real bosses’ so he has to listen to their instructions.
    Can’t blame him totally. He was just a nice guy. His ‘real bosses’ liked him for much of the 18 years he was kept there.A lot of ‘deals’ got done according to the wishes of his ‘bosses’
    Too bad for LGE. The post of CM comes with all kinds of challenges. As a politician, he needs to take these challenges head on. It’s a learning curve for him. I suppose he has done reasonably well so far.

    Can someone, maybe the current State Government get a copy of the original Trust Deed and post it on the net so that we can all see for ourselves what was the Settlor’s original intention. If it is a charitable trust for the benefit of a specific class of people, this trust can be held in perpetuity and not subject to the 80 years rule (trust period).
    The difference between charitable and express private trust involve the following considerations:
    1. Certainties : a charitable trust do not need to fulfill the certainty of object rule that is the Beneficiary need not be specific.
    2. Income Tax : a charitable trust is free from income tax whereas the other type of trust are taxable. (So was any income tax paid all these years?)
    3. Local taxes : a charitable trust is exempted from all local taxes.
    4. Perpetuity Rule: a charitable trust is not subject to all aspects of perpetuity principle. Under this rule a charitable trust must vest during a certain period defined by law and is not subject to alienability rule.
    Whoever was the Trustee (if indeed a Trust exist) is governed by the Trustee Act 1949. It is fundamental for every Trustee to carry out the terms of the trust. If the Trustee fails to do so, he may be removed as Trustee by a Court even if no harm has been done to the Beneficiary or to the trust. The Trustee has to act honestly. Failure to comply with a clause in the trust deed amounts to a breach of duty. Such breach of duty may or may not amount to a civil or criminal breach of trust depending on the circumstances of the case.
    So does this Trust exist?. If it does, what were the original contents ??. Need documentary proof lah !!

    Solution is been worked out at the moment but what the rakyat would like to have is some decent and civil answers to the many questions raised about kermit’s complicity. Please don’t take us for fools KTK. You have a lot to answer to.

    More importantly is that we will not forget come next GE. Your answers or your lack of answer will determine how many people will vote.
