The title of this post is in fact the unedited heading of a press statement released by YB Tian Chua that I received by email.

On July 21, the PDRM held a press conference to justify the violent conduct of police personnel. An edited video footage was released to the press in order to show that BERSIH demonstrators were aggressive and provocative. The PDRM claimed that they had only used minimal force against the peaceful assembly.
One particular clip showed the scene where the crowd marching out of the KL Sentral were met by a row of policemen. The video is said to show me leading the demonstrators running to the front. The PDRM asserted that it was an evidence of provocation.
Subsequently the video has been broadcast on prime time TV almost daily, with the objective of depicting BERSIH rally as violent. This edited video does not give the true picture of what happened at the tunnel that day.
The PDRM has launched an all-out media propaganda war to demonize BERSIH. Although the police did not specifically accused me for “charging” the police, reports in mainstream media insinuate that I and other demonstrators intended to “attack” or cause physical harm to the police officers.
This is far from the truth. From the video, it was clear that the policemen had their guns loaded with tear gas canisters. At the time, the crowd was trapped in an tunnel-like enclosed area. The group included BERSIH chairperson Ambiga Sreenevasan, Anwar Ibrahim, Wan Azizah, Hadi Awang, Lim Kit Siang and other leaders and participants.
For anybody in that circumstances could notice the danger of staying in the enclosure once the police fire the tear gas. The video footage only showed a few people rushed out toward the open air, and tear gas was fired directly into the crowd.
The video also showed that the police fired the tear gas canisters horizontally into the enclosed zone non-stopped. The police action was evidently malicious and intended to cause maximum harm to the peaceful group without warning. It was unprovoked and unwarranted action. It was police brutality
Hundreds of people were eye-witnesses to the incident. The edited video cannot distort the truth. The government should accept the responsibility of excessive force against peaceful BERSIH rally. The witch-hunt whether on me or other participants cannot absolve the guilt of brutality on 9 July.
The video also showed that the police fired the tear gas canisters horizontally into the enclosed zone non-stop. At least 12 shells were fired in a matter of a couple of minutes. 3 persons suffered injury to the head. The injuries suffered by Anwar Ibrahim’s bodyguard Fayyadh Afiq Al Baqry who had his left cheekbone crushed were particularly serious.
I call upon the police to cooperate fully with the impending SUHAKAM inquiry where I believe the facts will be presented by all interested parties in a public inquiry. Let the public then judge based on those facts.

What is he talking about? He was the spark that ignited the fire at KL Sentral and he still doesn’t want to apologize? Those ‘few’ people were the reason why they fired. As long as he does not issue a apology i don’t think the public will be on his side…

It makes no sense for Tian Chua to go on the offensive, as though to provoke the very brutal and violent PDRM personnel (I was in the peaceful crowds when we got attacked). If the situation was indeed as Tian Chua said it was, then I really don’t blame him for what he did, which was basically acting on self-defense.
Let’s at least give Tian Chua the benefit of the doubt. Sadly, from my own experience I cannot do the same for the PDRM, and the UMNO monkeys who keep spewing rubbish and lies.

Tian Chua’s gempur video was up on you tube almost immediately after 9th July. What kind of editing done on that? Looks exactly the same as the one shown by police.

Tian Chua said he charged cause of possibility police will gas them but there’s also the possibility if nobody move, no gas will be fired. It’s like the game of chicken and Tian Chua moved first. Also his press release did not mention why he usurp the position of Ambiga as head of Bersih. He took matters into his own hands instead of wait for orders.

I am one of the public (who also atttended Bersih09/07/2011) and I am on Tian Chuan’s side.
Bersih was a peaceful march. So, why did the police turn up in such large numbers with tear gas, water cannons and chemical laced water and FRU? By what right and under what law did they arrest those wearing yellow t-shirts and Dr.Jeyakumar and the other 5? “Waging war against the King and resurrecting Communism”??!! Rosemajib’s big fat ass!
No way was TC any kind of spark that lit any fire at KL Sentral. The police coralled Bersih supporters like cattle and then expected them to wait meekly and patiently for the slaughter?
TC was not remotely armed with anything that could be mistaken for a weapon. Oh, of course, like Ambiga and others, he was wearing a deadly yellow t-shirt which shook the police to the core, leading them to suspect that Bersih supporters were going to fish out a bazooka or fire a hand-held grenade launcher?
Come on, the cops were itching for it and did everything to provoke Bersih supporters. I was there and no way were Bersih supporters going to give the cops the slightest excuse.
However rash TC may sometimes be in his actions, he is someone I would rather have on my side any given day and twice on a Sunday, than anyone from UMNO/BN or the leadership of PDRM.

I agree with dpp.
I was there for Bersih 2.
I was amongst a group of people near Maybank and we didn’t provoke the bangsat police and yet, they fire tear gas at us.
I saw with my own eyes 4 bangsat policemen were beating up a man and a Malay woman told the 4 bangsat to stop beating and you know what! the woman’s hands got tied up!!!!
We suffered from breathing difficulty and many people offered us salt and water….they were kind souls.
So, I am on Tian Chua’s side. Even if you do nothing, the bangsat will hantam you with their tear gas, or baton or their legs to kick you.
The video has been edited for sure….Najib wants to use video to tell the orang kampung that their bangsat policemen had been provoked. Just look at how they deny shooting teargas into Tungshin hospital including Liow Tiong Lai….they are all liars.
Why Haris believe UMNO? UMNO already told so many lies about Tungshin Hospital incident…they denied and denied and denied….remember?

I saw the videos shot by the BERSIH crowd and not the edited version by the govt. Clearly shows Tian Chua charging at the FRU unprovoked. Certainly a few leaders walking up calmly and negotiating with the cops there may have better results, but I guess someone wants to be the BERSIH hero, and doesn’t mind sacrificing the safety of his co-marchers.
Just admit to it, and apologize instead of twisting and turning like a nincompoop politician. Raw video footage don’t lie.

Err, I have never been in such a situation, but if the FRU had first let off the tear gas, I don’t think I’d be waiting for someone to say 1, 2, 3 before I start running!! Tian Chua you need to respond to the circumstances exposed here!! Your statement is in response to RTM’s airing and your response assumes the running towards the FRU commences after they fired the Tear Gas. If that had been the case you would not be seen running forward and then back!!

The PKR condemned the PDRM for “attempting to murder” Anwar by shooting the tear gas canister… But it could now probably be that the PDRM did not expect someone to charge towards them and thus fired right away…
Of course PDRM could still be intentional but we’ll never know…
What’s appalling is how people do not compare the way Tian Chua lead the rally with the former (also) Vice President of PKR Sivarasa, who led the rally in Jln Pudu and likewise got flanked by PDRM and negotiated peacefully with the PDRM until PDRM decided to arrest him… A great leader would not charged toward the authorities because “he has no choice” or because “the circumstances forced him to” yadda yadda…

That guy is an insufferable clown – be sure next time you have a rally to allocate a separate location for him alone, well away from the rest of the attendees. Having said that, being half-heartedly ‘rushed’ by a dozen people with empty hands from 40m away doesn’t seem like the best ever justification for shooting people in the face with tear gas canisters, particularly when they were shooting into the part of the crowd that didn’t move – *behind* the break-away group.
In most countries where there are injuries at demonstrations, the rule of ‘proportional response’ dictates that the security forces suffer as many injuries as the demonstrators – and injuries are typically *lighter* as a result. Even faced by a careening Tian Chua, there’s no justification for yet another example of serious injuries and death at the hands of the police while they go home without a mark on their uniforms.
What would have happened if they hadn’t fired? Were they so frightened of being bitten again? The presence of Tian Chua is a confounding factor, but that video convinces me of nothing other than that the police were intending to ‘up the ante’ – to aggravate an already tense situation for the unmistakeable purpose of provocation. Was Tian Chua doing the same thing? Maybe – but it is as obvious to me as it must have been to the police that he didn’t have the same support – neither numbers nor enthusiasm.
It’s unfortunate that other people have to pay for Tian Chua’s behaviour. Is it time for his constituents to demand the by-election they are legally owed?

The rakyat at large would not easily (if they are thinking) accept a small clip instead of a full length documented inquiry. I have been to rallies before for example the last one to support Tahrir Square (Egypt uprising) in front of the US embassy, and there was an incident where police are easily provoked by a few demonstrators trying to walk past, arrest them, and when others come to their aid to resist their friends been arrested by force, fire at them with tear gas and seem to use disproportionate force.
We are dispersing after the demo in my case, and we were made to walk into a narrow pass-through area because the police personnel were not to budge in the middle of the road, and so shoving happens as more demonstrators were moving forward (to disperse). I passed that narrow passage with my two sons calmly and after some meters heard a commotion behind and smelt tear gas, and sought better air in front of Tan & Tan building, stopped and looked back to try to understand more. I saw one photographer running towards me and rested as his head was bleeding and asked the others why and they told me that the narrow passage caused the clash and police started hitting him.
Somehow i wonder if there is special tactics employed here as the police is a professional force with special training and under a tactical leadership to do something during such circumstances, though i do not understand much of it (as i am not a police personnel trained for rakyat control). Perhaps they are acting like this all the time under really professional training or not so. Thus a full Commission Of Inquiry into police conduct of treating rakyat will be important and needed.
Remember that we did have a report on the police before but do people remember it and did the authorities act upon it? I am a citizen of this country and why i am angry at taxpayers’ money been abused to protect more taxpayers money been corruptly taken away by politicians that fooled the masses and remain in power. TV showing TC as bad is a propaganda tool to divide and rule. We are still falling for something left behind long ago by the colonial British.

As expected, Tian Chua doesn’t address the *main* issue – why did he stupidly lead Bersih rally supporters to charge at the FRUs. The latter then reacted the way they would’ve reacted when being charged by mobs.
Instead he shifts the blame on PDRM (again) like a broken record.

Looking at Tain Chua’s behavior one thing is clear , he is not a team player. There was no necessity to charge out and risk the wrath of an already trigger happy PDRM. Moreover if he wants to be so brave and charge out, do it alone and don’t lead others to do so too. Moreover do it on any other day other then on the BERSIH rally day. Heck he could choose another day and wear his PKR T shirt and charge into Sg Buloh prison for all we care. The rakyat do not want BERSIH to be hijacked by PR. This is not about picking sides of a divide. It’s about being transparent and answerable to one’s decisions and actions. Tian Chua had the option of leading the crowd out of the tunnel calmly by the sidelines skipping the dramatic 1-2-3 gempur. Along with leadership comes responsibility and that is what we expect from an elected leader. Tian Chua needs to explain what actually transpired in that tunnel on 907 that led him to do what he did.

I have read all the comments above; some were sympathetic and/or in support, whilst others were not in favor of Tian Chua’s action.
I have watched a video of the scene on Youtube (can’t remember the source at this moment) and from what I can surmise (as several of my colleagues and friends whom I have shared the video) is Tian Chua and the group were attempting o divert the policemen attention away from the tunnel, presumably to protect those inside that among those included his party boss. Call him foolish or whatever, but I respect him for his guts. It’s easy for us to sit at our desk and disagree based on Haris article, but for those whom were at the Bersih rally, I am sure you can appreciate the tense situation we were all facing on that day.

I am still wondering what all this fuss about Tian Chua so called “charging” into the police (fully armed for crowd control) with his bare hands.
1. What if he really charged at the police as some claim. So what do you want, for him to say sorry. Will he be happy after that. If he does not say sorry, will be do all things to put him into political pasture? Not sure what we want here.
2. If he reacted because he was trapped as TC seems to suggest, then what. Will all those who accuse him apologise. Even if you do apologise, will it make a big difference to the political situation in this country under UMNO/BN? I don’t think so.
3. Ah but some will say we must go back to the principles of our struggle. Whatever the reasons, any political leader should not unnecessarily jeopardise the lives of innocent persons around them. If TC did not charge maybe..just maybe the police would not have fired. Since I was there and tear gassed, I think the police would have fired no matter what and just because Bersih protestors were there. They fired at the crowd even though unprovoked all the time. To the police, you being there in the Bersih crowd is provocation enough.
What am I getting at. Well in short what I am trying to say is, we all have bigger fish to fry than to delve in this polemics on TC’s action. Let me put it this way. If TC does it again and again…then we should hang him out to dry.

I believe that tian chua was trying to distract the fru from firing at the crowd ,as can be seen, the fru were already in charge position and preparing to fire into the crowd.That is why the initial tear gas shell was fired towards tian chua and not directly at the crowd.
Todays announcement about the kapar seat was a disappointment.Its a case of being a king maker. I would like to ask the mclm on what basis the announcement was made.Was PR informed of this,was it made after consultation with related parties or AT THE WHIMS AND FANCIES OF MCLM.

Well done Haris. You’ve effectively shamed Tian Chua for apparently charging forward unarmed against armed personnels of the police force.
You’ve also managed to portray Pakatan Rakyat to be the hooligans eager to draw blood, when in actual fact, they are not.
You want an apology from Tian Chua? Seriously? Don’t fucking kid us. If you wanted an apology from an ally, you would’ve called him and asked him for it. Instead, you’ve gone about acting like an angel and crucifying someone else without first understanding the situation.
And what is the situation? The situation is the Rakyat is fed up with the government and its cheating ways. Do you expect everyone who participated in BERSIH to act like a monk, all the time, in face of tear gases and beatings without any retaliatory actions? Do you expect people to face beatings without adrenaline rushing through their blood?
Well done indeed. I hope you must be sipping champagne over your revelation of TC’s misdeeds. I’m sure you must have a lot of friends in school in the past, with you so eager to point out their faults to the public without them offering a defense prior.

Ian, the way I see it, Haris was only walking the People’s Parliament talk by not taking sides. He’s lambasted BN when they do something stupid and now when the PDRM has come up with a video extract supposedly showing Tian Chua leading the charge at the police, Haris is publicly giving Tian Chua the opportunity to clarify himself and for followers of PP to assess the information from both sides and intellegiently decide for themselves. Although I absolutely want to see BN removed by the next GE, I strongly support Haris’ effort to remain partial. You have every right to voice your opinion but no need to react so ‘agressively’ towards the man.

Apologies if the words came out strongly.
Haris must learn to confront these issues privately. TC may have reacted badly, but consider this, haven’t we all acted badly at some point in our lives? Can’t we settle our differences through a cup of coffee instead of airing grievances over the Net? Must we demand for public apologies every time the lines are crossed?
We all have a common enemy and must work together to end their rule, and this means tackling issues of differences in opinions and actions internally to avoid giving ammo to the enemies. If we can’t do that, what hopes do we have in getting rid of this parasite that is BN?
So you see, I’m not defending TC or PKR or anybody. Rather I’m lamenting about the lack of togetherness of the opposition. There are too many egos to handle and if we can somehow sort it out internally, we might have an early chance at achieving what most think is unachievable.
To me, this issue is trivial and totally avoidable. Don’t you agree?

Wow now MCLM attacking PR. Putting candidates to stand against PR precisely PKR. Why divide the opposition?.BN will be the winner then. I may not like BN but I give my hats off to how over the years they close ranks and stick together Any disagreements are dealt with in private. People know BN is BN no matter where they cast their vote now we have PR and mosquito parties like KITA, HRP, MCLM nibbling away at opposition votes. If this trend continues sorry lah another win for BN. No wonder Najib seems so confident these days.

Suren is a DUMB lawyer, why? I will tell you … look at his comments, he says the Constitution guarantees us the right to gather etc. Any laws in conflict with the Constitution is wrong. He is STUPID, go read Article 10 iof our Constitution, it says Parliament may impose laws to stop us from gathering. So is he that smart? No he is not.
Remember the woman he represented? She was supposedly shot by police for no reason. Suren is a dumb lawyer here again. Why? Well the woman says she was shot and DID NOT know until the doctor informed her that she was shot 5 times. Our police use 9mm or .38 calibre bullets. Would you feel me slapping you? Well … she was probably high on narcotics. The police SHOULD NOT have opened fire so easily BUT Suren is not a smart lawyer to let her say that she did not know she was shot.
So what do we have here? Another hero from PKR. This man is so highly respected? He is a joke … what attempted murder? The police will say they shot because Tian Chua charged … what intention to kill? What mens rea? None la … the case will not stand at all. Ask any proper lawyer …

Haris, just as much as I’m disappointed of Tian Chua’s irrational rush towards the FRU, I’m just as disappointed to read about Nedunchelian Vengu intention to stand in Kapar.
Sure he has the right to stand as an independent but with funding and resources from MCLM makes not much difference from BN govt tacit approval of independent MP Ibrahim Ali’s racial and hates speeches! Nazri’s comment ‘No action against IA is laughable.
So, by standing against PKR’s Manikavasagam, doesn’t that make a 3rd-corner fight, unless Manikavasagam doesn’t want to represent again in Kapar. Yes, it’s politically correct to let Manikavasagam know in advance but what do you expect him to say? That he is happy that an ally is supporting an ‘independent’ (doesn’t sound right) candidate who is going to stand against him. Sometimes it’s better not to say anything at all when in anger, nor to give ammunition to BN. The Pakatan allies have already agreed to hold rank and discuss any difference amongst them in private. So, I can understand some commenters’ angst of your public stand against Tian Chua.
The Rakyat has responded with BERSIH’s call for Election Reform Walk, the turnout and bravery of many of them give us hope again to take back our country through Pakatan. Which other coalition party can help us to achieve our hope? Tengku Razaleigh’s AMANAH?
Yes, I agreed that Pakatan needs to form a pact with all the other anti-BN parties in order to have a higher chance to capture Putrajaya. But how does it help if they are pitting against each other? Already we have HINDRAF trying to chip into Pakatan’s votes, can we really afford to weaken Pakatan’s chances in the next GE? I just wished all these anti-BN parties, Pakatan included, will come down from their high horse; instead of making demands or refusing to compromise.

Agreed that the police has been overzealous and merciless in the treatment of the marchers and unprovoked almost all the time. If the police were to allow the marchers to walk to their destination instead of blocking their way, none of such untoward incidents would have occurred. The police action should be condemned.
In this case, Tian Chua has to explain why he ran and if he ran before or after the tear gas were fired. The powers-that-be would be looking for reasons for their inhumane action. We must never give them any reason at all.
