_______________________________________________
Your petition to His Majesty the Yang DiPertuan Agong to register our concerns on the judicial appointments and to appeal for His Majesty’s intervention has been launched.
In October, 2007 5,036 anak-anak Bangsa Malaysia petitioned His Majesty, appealing that Fairuz’s term as Chief Justice not be extended, as was then sought by the Prime Minister. My sources tell me that His Majesty did take note of the concerns voiced by those 5,036 individuals.
That petition was launched before the BERSIH and HINDRAF rally took place; before Makkal Sakhti took hold of the imagination of the rakyat.
Given the heightened spirit of “people power” amongst the rakyat, it would be good if this petition could garner a significant increase in the number in support compared to the previous.
According to news reports, the position of Chief Justice falls vacant on 18th October, 2008.
I would like to get the petition to His Majesty by the 15th of September.
That gives us over a month to get a decent number of signatures.
As was done with the earlier petition, what you will see here is not the final document which will be forwarded to His Majesty, in that the requisite court language has not as yet been weaved into the document. That will be done later, without any change to the substance of the petition.
Also, those signing the petition will also have to avail their identity card numbers. Please note that pseudonyms and names without ic numbers will be deleted.
People, this petition is yours. Its success or otherwise, is in your hands.
You can access the petition HERE.

While the poor and middle-class are squeezed, an elite group gets breathtakingly rich. We have the distinction of having the worse income disparity in Asean. A re-distribution of wealth is under way from the poor and middle-class to a select group of politically-connected elite.
The end result of this re-distribution will be a small group of super-rich while the majority are pushed into poverty and the middle-class shrinks. This is what happens when the rich gets richer and the poor get poorer.
There is much that is wrong with Malaysia . The responsibility for pulling the country backwards can be laid squarely at the door of the ruling regime. It is BN’s mis-governance, racial politics and culture of patronage which has seen the country regress economically and socially.
We seem to be sliding down a slippery slope, further down with each passing year of BN’s rule. Another five years of BN rule and we’ll be at Indonesia ‘s standard under Suharto. Another 10 years and we’ll be touching the African standard. What a way to greet 2020.
Is there any hope for Malaysia ?
Faced with the reality that BN will never change, many Malaysians desperate for change turn their lonely eyes to Anwar Ibrahim.
Pakatan Raykat has promised to treat all races fairly, to plug wastage, fight corruption, reform the judiciary and make Malaysia more competitive.
But some have questioned whether we can trust Anwar and his loose coalition of disparate parties..
The question is not whether we can trust Anwar and Pakatan Rakyat but whether we can afford not to.
Can we afford another ten years of BN’s misrule?

Dear Haris,
Last week, Raja Nazrin said the royalties are not for ceremonial purposes only.
The royalties in office have not given us any reasons to think othewise. What more, previous petitions sent by the rakyat went unanswered.
But I am THE rakyat and if this petition sum up our determination for reform for the sake of the people and country, then I’ll sign this petition even if it didn’t see the day of light.
Let those who have the power to make a difference but refuse to act forever hold their peace.
Will get some friends to sign too.

Hi Haris,
Have signed the petition even though I have my reservations regarding the King’s ‘powers’ to actually do anything.
I was one of those who thought our last hope is the King and we did speak on this last year. But I am not convinced the King can do anything (due to his limited powers).
Have I missed something?
We are a nation in crisis and lately all we do is exchange ‘sensational stories’ and vent our frustrations. Is there any programme out there formulated by anyone or party to actually put our country on the right track?
Remember we once spoke of having a ‘legal committee’ to evaluate evidence of whistle blowers’that would be carried out objectively. This could be the start of a pressure group that we need to get things done in a proper manner. Facts and law as opposed to speculation (that does nothing good for the country).
We need to move forward as a maturing democracy that does not solely depend on political parties for an improved Malaysia.
We live on hope for a better tomorrow that starts today. Cheers.

Haris,
I risk sounding like a broken record, having repeated this message on my own blog so many times. I just wonder why it is that the Memo on Media Freedom has not received the signatories it needs.
I’ve just revisited the petition you set up, and in a short period of half a day, it has already garnered more than a thousand signatories. The Memo on media freedom has less than 900.
The media, like the judiciary, is not in its best shape. But we have not given up totally on the judiciary, hence the response for this petition. But neither should we give up on the media.
I apologise for “pimping” your comments section on a somewhat irrelevant post, but the link to the memorandum on Media Freedom is HERE. The memo is intended to be submitted to national leaders this Hari Merdeka, to state leaders this Hari Malaysia.
We are looking to mending this society. And not unlike the judiciary, the media is an important part of us.

Dear Haris,
Firstly, many thanks for organizing the Petition. I’m not a laywer by training, but just reading what you wrote, and just knowing about the rapid promotion of someone like Zaki is enough reason and concern for me to sign the petition, despite the smaller reservations of not fully knowing the implications such as who would become CJ if His Majesty followed your proposal to appoint the most senior guy.
Anyway, I am sharing your Petition with my family and friends, and have taken the liberty to lend support to this cause in my blog here – http://fusioninvestor.blogspot.com/2008/08/important-read-this-petition-and-sign.html
I am extremely puzzled – why is it that our Society requires someone like yourself to highlight this, and not an organization like the Bar Council who is supposed to represent lawyers who are supposed to be in the know? Shouldn’t the Bar Council have at least a professional sub-committee that would initiate things like this which are in Rakyat’s best interests?
Take care,
Seng.

It now appears to me that the problem began with the concept of “Ketuanan Melayu”.
This concept was introduced around the time when Malaysia was working hard to achieve independence from the British.
As we are all aware, the malays were marginalised in the economic sector and perhaps to a large extend the political side as well.
The malay leaders of the time tried to boost the spirit of the malay community by introducing the concept of “Ketuanan Melayu”.
So, the malay leaders at that time used the concept “Ketuanan Melayu” as a rallying point not as a tool to oppress or rid the non-malays, but merely as a cry to prevent the malays from drifting towards oblivion in the era of Malaysia as a country.
While the other concepts ranging from ethnic cleansing to white supremacy are meant to dominate and wipe out the other races, “Ketuanan Melayu” is only meant to help the malays to get to equal footing with the non-malays.

Perhaps there’s some civility or a sense of shame within the MCA at lest coming from this group statement. Lest there be any need for condescending after all a statement isn’t enough today; considering the inaction from these groups as against the overall public detestations and the magnitude of despicable shamelessness from the components.e.g.
“Let the court decide on the sodomy issue,” said Permatang Pauh Umno division chief Datuk Abdul Jalil Abdul Majid.
These guys just don’t get eh. We do not trust rely on or have faith in the courts, not only the court but all institutions of gomen except the opposition – not even parliament is justice and a genuine interest of the people guaranteed. Even in their own personal capacity BN/UMNO officials affiliates sympathisers we passionately come to dislike at this juncture in our contemporary lives. These vagrants just add nausea whenever they are heard or seen in public. There’s nothing constructive futuristic or promising about these people any more. The mere mention of their name sake even their off-spring into public corporate ordinary life reaches fever pitch antagonism. Just go! Goooooooo! My wife and I switch between channels whenever these morons appear on the TV- it doesn’t matter what they have to say, we discontinue news papers delivery to our home , we don’t spare time to ready the ones that are free at the office and we take the free SUN at the guard house every 3 days to lay bed for the kids Hamsters at home – seriously! not even a glance. It is what they also shit on.

Bro,
I’ve done it. Appointing Zaki next to line is an unfair advantage to other judges who are much senior in level and rank than him. To do so is to say that UMNO has interfered with the judiciary; more or less the same as the police now – Abdullah is telling the police to put the guilty verdict on Anwar from the beginning disregarding of all evidence.

Saudara Rastaman.JB,
The Malaysian flag belongs to thr Rakyat, not the ruling BN coalition, not Pak Lah, nor any of the Bung, Nazri, assorted MPs whom I despise.
Just like the people swear and owe their loyalty to the nation (in spite of some attempts to divert that to the ruling BN coalition), we should honour the flag as a symbol of our country, not the jokers we do not honour who so arrogantly think they rule the people.
By all means fly the flag upside down that is a recognised sign of distress if you so choose.
But I think we should not stop flying the flag just because of some politicians who engender disdain instead of the respect they apparently crave and demand.
To some extent, that may even be a measure of victory for them, that they have succeeded in exerting their vile influence over patriotic rakyat to the extent that these rakyat have given up a symbol they have every right to fly.
As for me, my Jalur Gemilang has been raised since August 1st.

Harris, why not approach malaysiakini to do a feature on this very worthwhile petition?
malaysiakini is the mainstream media of the online world. Correction, it is already a mainstream media in its own right, already exceeding the Star in readership.
If this guy Zaki gets to be CJ, it would be an unmitigated disaster for Malaysia. No innocent would be safe from unjust conviction while guilty VIPs can escape justice.
Everybody must try to influence as many people as possible to sign the petition.

I would sign it but for two things:
1. The petition goes on and on about the specific appointment of Tan Sri Dato’ Zaki. I do not feel I know enough about his sppointment to agree to such strong statements.
2. I am not sure that appointment by seniority only as proposed is always a good idea.
Perhaps a more general petition would go down better with peotential petition signers. Or otherwise if some background could be provided for (1) that would be helpful but this would require a lot of invested reading time. And (2) remains problematic no matter how much background there is…

Charis Quay,
Many has mentioned previously that Zaki is “most likely” targetted to be the next CJ, due to his unprecedented and rapid promotion and his strong connections with UMNO, notwitstanding his past lack of integrity.
These are huge concerns. Why?
Because of the repercussions. The CJ role and position is an extremely important position, so much so that the state and reputation our Judiciary in future will be affected.
It is to Rakyat’s best interest that we do not have someone like Zaki as the next CJ. It is not personal, as I personally do not know Zaki. But I do not want someone like Zaki to be the next CJ. Surely we must have better candidates to be the next CJ.
Presently, you are aware BN controls the Legislative. BN is the Executive. And if BN / UMNO also controls the Judiciary, then, we are no longer a democratic nation, but a nation governed by a Dictator. Why? He makes the laws anyway he sees fit without objections(Legislative), he implements the Law (Executive), and he Interprets the Law in any way he sees fit also (Judiciary, via CJ).
The problems facing us is that without a JAC (Judicial Appointments Commission), we the Rakyat will NEVER know whether the PM will submit Zaki’s name or not. But if he did, and if the Agong agrees to it, then, Zaki will be the CJ for a very, very long time. We must alert the Agong officially, and this can be done via this Petition.
Unfortunately, your stance – to stand aside and do nothing – will over time will become equivalent to condoning the appointment of someone like Zaki.
In short, by doing nothing, you are an accomplice to turning Malaysia into a country run by dictator. Once Zaki is appointed, it would be too late to turn the clock.
So, it is without question, and is obvious to me, that NOT signing the petition is far, far riskier.
My preference is of course the establishment of a Judicial Appointment Commission. But as you know, UMNO Cabinet Ministers have turned this down. Why? The obvious reason is that with a JAC, UMNO no longer controls who to become the CJ. They much prefer someone like Zaki to be the next CJ, who will do the party’s bidding.
You must decide whether you want to wait for the “perfect” system (whether seniority or other criteria), or to alert the Agong about the lack of suitability of Zaki as the CJ.
Yes, I do not mince words. I write based on what I believe. I hope someone will correct me if my belief is wrong.
Seng.

Hello Haris
So did the doctor and the chemist stood firm on their ground that there is no evidence against the sodomy allegation? I did not follow any of the news in either the msm or the alternative news to confirm because I’m not feeling that well to surf the internet and there is other things occupying my mind right now.
Also, RPK should update his entry in the same posting as to whether the doc and the chemist stood their ground.
As for the petition to the YDP Agong, I’m still waiting for the previous two to be acknowledged by his majesty.

mosesfoo,
You asked : So did the doctor and the chemist stood firm on their ground that there is no evidence against the sodomy allegation?
response : Don’t know yet.
You said : As for the petition to the YDP Agong, I’m still waiting for the previous two to be acknowledged by his majesty.
Response : The second was never sent in as before we could conclude the signature collection process, I got word that Zaki had been appointed President of the Court of Appeal.
As for the first, what acknowledgment are you expecting?

Harris,
Will you be getting Raja Petra Kamaruddin’s help in fine tuning the language for royalty? (haha)
Without a JAC, the CJ will control the appointment of judges to hear cases and the promotion or transfer of judges. The potential for abuse is abundant. In 1998, junior judge Augustine Paul was promoted to a high court judge specially to hear the Anwar case and we all know what happened.
Cleaning up the judiciary starts from the top with a clean CJ. Thanks for your efforts, Harris.

I read with interest the posting of Punithan Shan http://indiansmalaysia.blogspot.com/ and PEMUDA MIC BLOG http://pemudamic.blogspot.com/2008/08/vulgar-and-slanderous.html
At first I was very angry with the comments of Blogger MARGEEMAR http://margeemar.blogspot.com I even posted my comment in Punithan Shan’s blog to express my sympathy and support for what I had assumed as an uncalled attack by MARGEEMAR on Punithan.
However, I did take the trouble to read up Margeemar’s blog and Punithan’s blog and their previous postings. What I felt was utter disgust and anger not at Margeemar but with Punithan Shan and his comrades from Pemuda MIC. I was really taken for a ride with their spin. I may not agree with the tone of language that Margeemar used on Punithan but I can understand why.
After reading Margeemar, Punithan and Pemuda MIC Blogs, I must say I agree 100% with the issues and comments raised by Margeemar with regards to Punithan. Punithan like Pemuda MIC are really a bunch of racists. I dread to think that someone like Punithan is going to walk the wards of a Hospital in Malaysia in a few months.
I’ve taken the liberty to extract excerpts of the racist, pro-BN/MIC and anti-Pakatan Rakyat/Anwar comments I found in both Punithan and Pemuda MIC Blog. I hope all truth seeking Malaysian’s will not fall for such deception again.
PUNITHAN SHAN Blog
“Before GE-12 we witnessed almost all the PR indian YB’s focused on INDIAN AGENDA.
But now are they turning their heart and mind to “Anwar’s agenda”??
Having a press conference for PSD rejects and opening kelab penyokong PAS is not really an Indian agenda.
I understand that they representing Multiracial party which i say have very little “resources” for Indians Agenda. But they as the Indian’s reps in PR should be able to find a way to walk their talks.
Since GE-12, i can proudly say MIC is WALKING THEIR TALK. I am not boasting about the re branding. I am talking about their agenda’s for Indians that they proposed to the government and now we are witnessing the “outcome”. I have took the afford to post on all their achievements since APRIL 2008. Kindly browse my blog.
It was just a matter of time and MIC would have gotten 2 full ministers in the cabinet. It was just matter of time and MIC would have gotten more EXCO in states. It was just matter of time and we would have been gifted with MORE voices in the Government. All that would have happened if MIC won atleast 80%.
But we denied it. The people denied that gift. Ok fine….”voters are always right”.
Malaysian Indians for the 1st time expressed their dislikes over BN publicly .So we made the government realize that we are not happy and we need more. And unfortunately now MIC the sole Indians rep in the government is left with only few reps. Is this what they wanted?? Is this for good??
PEMUDA MIC BLOG
Who are practising the vulgarity now ? Who taught the ‘pariah’ word ? Why look down at Indians ? What are the reaction from other bloggers ? Are they only going to voice out if the victim is non-MIC ? Rather than looking at the perspective of PKR Indians, DAP Indians, BN Indians, Hindraf Indians….. just remove all the tittle carrying Indians there … and just be an Indian… Lets Unite….
