My comments are restricted to layman points of law here and not to continue with the various views expressed so far.
There appears to be a dilemma within our legal system with this recent judgment (pardon me if my reading is incorrect). I call it the Joy Dilemma and it goes like this (quite similar to “Catch 22”):
a)To leave the muslim faith legally and to enable one to change one’s religion with the registration dept, one needs to obtain a “certificate of apostasy” from the Syariah Court.
b) The Syariah Court can only hear and rule on matters pertaining to muslim persons and the muslim faith
c) If one already leaves the muslim faith, can one seek legal recourse at the Syariah Court?
d) If one seeks legal justice at the Syariah Court, that would also imply one must be still professing the muslim faith.
Either way, one is caught in the Lina Dilemma!
