Malaysiakini reports that justice Abdul Aziz Abd Rahim upheld Pakatan Rakyat MB Mohammad Nizar Jamaluddin’s argument that he is the legitimate menteri besar.
Zambry’s application for a stay of proceedings pending an appeal was rejected by the judge.
justice Abdul Aziz ruled that Sultan Azlan Shah had no power to order Nizar to resign, and that the Sultan ought to have directed a sitting of the assembly be convened with a view to the tabling of a motion of no-confidence against Nizar.
Surely fresh elections are the only way out of this mess?

Hell, if they need a professional to run, I will also volunteer!!! hehehe… Time to get rid of clerks, postmen, railway gurads etc – no insult to those who are doing their job professionally, but you do need some management background to manage the state!!!

“However, BN could still have the upper hand with regards to the state assembly.
While the court has not recognised Zambry’s appointment as menteri besar, the appointment of new state assembly speaker R Ganesan is still valid.
In view of this, Ganesan could call for an emergency sitting where a motion of no-confidence would be moved against Mohammad Nizar”….M’sia Kini.

When they forcibly removed Sivakumar, what they did was to return back the right for him to vote in the assembly. Previously he can’t because he is the speaker and BN would have won with 28 vs 27 majority but with Sivakumar voting, wouldn’t it be a deadlock of 28 vs 28, all other factors remaining constant?
Nanda
May 12, 2009
In other words, either way would lead to the inevitable.
Put back Sivakumar as the legitimate Speaker, the motion to remove him will not be heard and the frogs and the illigetimate MB would be asked to leave.
Continue with Ganesan, deadlock of 28 vs 28.
Until perhaps another RMXX million ringgit is taken by any of the remaining PR aduns to crossove or any of the BN adun to do likewise.
Or, no one crossing over, deadlock, force the assembly to dissolve and vote again because I can’t see how they would be able to form any unity government after this mess.
A layman’s analysis though. MAybe totally wrong.

Could it be that Nizar wins only because Najib allows it? I remember reading that he has ‘soften’ his stance yesterday regarding the matter, so maybe it’s a signal for the judge to give it to Nizar. Kinda like give one inch to gain a yard Sun Tzu type of strategy perhaps. A possibility, no?
So, while we rejoice at the decision, and are happy for MB Nizar, we must also be wary of background UMNO/BN movements and initiatives. Do not be so readily happy until we let down our guard and to see our hard fought rights snatched away in the midst of the euphoria. Actually, we rakyat are so easily placated …. if only the institutions are genuine and sincere in performing their functions, it’d be easy to satisfy the rakyat.
Anyway, Congratulations, MB Nizar!

Bro,
Knowing how desperate BN can get, isn’t it possible for Ganesan to call for an assembly sitting and pass a motion of no confidence against Nizar before PR has the chance to seek an audience with the Sultan?
Plus, the Sultan is in the States. As unethical as it may sound, the above could happen couldn’t it?

The Hartal MSM team is glad to hear that Malik Imtiaz ended his association with Malay Mail on the day the Perak assembly saw bedlam.
The 35 comments to Imtiaz’s posting unanimously laud his decision.
However Hartal MSM is appalled at your highly misguided comment (quoted below from Imtiaz’s posting) asking him to jump from the frying pan into the fire.
We would request that you to read and evaluate theSun’s coverage of, and lacuna on the Perak fiasco before recommending Malik Imtiaz to soil his reputation writing for the Vincent Tan-owned rag — the billionaire, like Najib Razak, carries a perception baggage in connection with Perak too.

Harris,
The BEST solution for the BN is to get the 3 ADUN to resign and call for a bye-election. A state election would cost more and we need to save all those money at a time like this. BN has to now tell the 3 friendly ADUNs to be “friendly”. Only in this way can BN save some face or be prepared for a total wipeout in Perak.
Otherwise a State election would not only cost more but cost BN a “lot more”.
It should be as what it was before the for the frog hopping.

Brother Haris, the fresh poll is the only solution to mend the crack between the people and the Royal family as we have seen thus far.
I believe HRH Sultan and Raja Muda will make everyone in Perak happy.(Only those goons who are afraid to face the rakyat are the sad ones.)
May be HRH Sultan and Raja Muda should tell the two PKR frogs-Go back to face the Rakyat. I don’t want CORRUPTs to contaminate the holy assembly in my state.
The Ruler must tell the DAP lier-Go back to face the Rakyat. You are a shame to the state, a big cheat, you are not fit to be in the holy assembly.
And to Najis and his hooligan followers, walk the talk or else, you and your party will be perished in the next GE.

This Perak decision may be the trade off?

BN trying to convene an illegal sitting of the state assembly officiated by the illegal speaker Ganesan. FRU needed to block the state assembly from the people whom the state assembly is supposed to serve.
Since Zambry has now been declared the illegal MB, therefore the entire May 7 State Assembly was also illegal because the state assembly was not called by the Speaker of the House but cloaked as a royal emergency sitting approved by the Sultan of Perak on advice of the MB of Perak.
And since the MB of Perak has been declared illegal, logic dictates that the emergency sitting of the state assembly was also illegal. This means that all motions passed in the House on May 7, 2009 is illegal. Sivakumar is still the legal Speaker of the House. Any motion has to be approved by the Speaker.
So it’s basically game over for BN but of course you didn’t think that BN will just sit down and let Perak slip from their grasp again do you? So they have deployed the FRU and possibly thousands more police and goons to Perak. The final showdown is yet to be witnessed.

Malaysia’s state of affairs is like a roller coaster ride sometimes, with, ‘one day up and the next-day down’feeling for the rakyat and at other times a ‘merry-go-round and round’ feeling, not going anywhere at all. Are Malaysians going cuckoo?
The Parliment & the Dewan Rakyat are like the amusement parks for the rakyat. The amusement park ‘operators’ are real fun to watch for the rakyat, not the whole show though! The storyline is always the same boring ones all these 51 years. The Directors/Producers of the show remain behind the scenes, commenting only when necessary.
Making a fool of themselves actually, with all their costumes it’s even more comical. When will all these stop? But, to tell you frankly, we are not amused at all! So, if you are responsible people, prove us wrong and bring all these to an end peacefully without any more unnecessary alarms to the general public.
The lawyers said, they want to be respected as they are, but the Dewan is full of them who misbehaved in general public. Can all lawyers show the public the right way to behave first? Put an end to this if it is within your means and if you claim you know the laws of the country in your finger tips.Do this for the rakyat,if you care.

Dear PR Leaders and PR supporters,
Congratulations to DS Nijar and PR Leaders for they who won the 1st half battle of the constitutional issues but don’t be too carried away for this moment.
UM-No/BN (Najis/Zombie) not going to just let off the current political developments of the court ruling as they would appeal soon. It might be a strategy of getting the Rakyat thought that the judiciary commisssion was acting justifiably in the 1st half of this battle but on the 2nd half, the court may ruled otherwise. Be reminded that this agency (JC) is still the UM-No/BN horse.
Once this happen, PR will have a major set back and cry fouls of the JC’s integrity and therefore any objections by PR of the court ruling that cannot be accepted by PR would be seen as uncivilised or “KIASU” !! (The 1st half UM-No/BN can accept court ruling but 2nd half court ruling cannot be accepted by PR).
PR just have to be very careful and strategizing the next course of action.
Anyway, as supporter of PR, I still believe in people’s power and the best solutions to end the whole episode is to dissolved the assembly and go for a fresh elction.
The PERAK peoples and MINDFULL Malaysian are 1000% behind PR.

Guys you forget one thing and I think Datuk Nizar has also forgotten it.
he actually does not need the Perak’s consent to bubar the DUN anymore if the May 7th sitting is deemed illegal as Zambry the Illegal Alien is not the MB at the time and cannot advise the Sultan.
Cause it would have passed the max time elapsed before the DUN must sit.
Automtaically the DUN is dissolved and elections must be called.
Why would Nizar need the sultan punya consent ?

The unexpected result was a sort of air-refresher that we cherish in our otherwise contaminated politic.
It may be short-lived , we dont know ,God knows.
Vote of no confidence can happen either way since the difference is marginal.Today I have 1 majority and tomorrow you have i majority so the ding-dong goes on.
The answer is a Fresh Elections just the way we cherish the Fresh Air.
The answer my friend is in the Rakyat , the answer is in the rakyat. It’s a close fight in the Silver State as both parties are having their own share of supporters.
Let the rakyat decide the Final Countdown and accept whoever the victor is . No sour grape cos it’s a fair fight like a man the way we want it.

Per Malaysiakini: “The judge noted that the Sultan of Perak can use his absolute discretion in the appointment of the menteri besar and also grant a dissolution to the assembly.”
The Sultan can say NO to Nizar’s request for a dissolution of the state assembly. Then BN will call for a motion of no confidence and Nizar will be booted out – legally.
So there you are. No need for fresh elections. Rakyat should be pleased there is no wastage of money. Najib rocks!

Err.
Ok. From my understanding, V.Sivakumar is still the valid speaker.
If a emergency sitting is to be called, what he can do is suspend Hee Yit Foong for a day, reason being for bringing the house into disrepute. A few other BN assemblyman could be suspended as well.
Furthermore, the Rights and Privileges Committee is to meet ASAP and find Zambry and Co. guilty of impersonating the Menteri Besar and his agents and suspend them during the emergency sitting.
So, in essence, suspend 4/5 BN assemblymen for May 7 incident. After kicking them out, move to suspend Zambry and the “Fake” Exco through an emergency motion in the house. Finally, move for a confidence motion in Nizar. Does this make sense and doable?

Of course its fresh election. Sultan of Perak may make mistakes and even if he is partial, knows he can’t pass up this chance to clean up the mess..
The real question is why Najib don’t see that he should thankful that this allow him to clean up his own mess. He was screwed from the start and he just did not know it.
If he keep insisting he is not part of the problem, then he might as well kiss his career good bye. Its only going to get worst, a lot worst and he better come out with better plan than the one he has right now…

Yesterday at the commemorative Forum for May 13th,atthe PJ Civics Centre Auditorium, one could gauge the state of affairs we’re in in this country.
The People, Malaysians from all walks of life, gave MB Perak, Nizar, a thunderous applause as he came into the auditorium and later received standing ovations.Cries of “Nizar” rang out to the accompaniment of never-ending clapping. It was very uplifting, especially as a gloom had descended upon Malaysians over the last few days.
The light surrounding Nizar was in stark contrast to the awful darkness that Zambry had unleashed over everyone. Nizar was clearly the Peoples’ light dispeling that darkness.
That was the electrifying presence of Nizar Jamaluddin, so rightly chosen by the people. His oratory, loud and clear was equally arresting…he began from a verse in the Quran…. that the Almighty had created all of us from one man and woman, and that is the reason why we are all part of one family.
What did the sinister looking Zambry get? …boos, boos and more boos, when his name was mentioned. We also laughed out loud at his attempt to wear Mahatma Gandhi’s shoes…..!!!!!
Every speaker, including Anuar,Nizar,Kit Siang,Tengku Aziz, Ragunath, Tricia Koh, Azmi.. echoed what the people want….fresh elections to determine the rightful MB of the State of Perak.
It was Nizar, Nizar all the way
With clapping mixed in his path like mad!
The general concensus was that PM Najib was afraid BN would lose, and lose badly if fresh elections were to be called for, in Perak.
There was ostensibly no FEAR, not at all.We were a huge sea of Malaysians, so totally happy and proud and we’re waiting hungrily for the re-birth of Democracy in our Malaysia.
